fa حقوق مهندسی و تبیین جایگاه آن در بخش ساختمان تخصصي Special پژوهشي Research <span style="font-size:14px;"><strong><span style="color:black;"><span style="font-family:Mitra;">زمینه و هدف:</span></span></strong> <span style="color:black;"><span style="font-family:Mitra;">مقاله</span></span><span style="color:black;"><span style="font-family:Mitra;"> حاضر در طی روند مطالعاتی خود اهداف شناخت مقررات ملی ساختمان، بیان شرح وظایف مهندسین طراح، ناظر، مجری و مسؤولیت آنها و </span></span><span style="color:black;"><span style="font-family:Mitra;">شرح</span></span><span style="color:black;"><span style="font-family:Mitra;"> حقوق مهندسی را دنبال می‌نماید.</span></span><br> <strong><span style="color:black;"><span style="font-family:Mitra;">مواد و روش‌ها:</span></span></strong> <span style="color:black;"><span style="font-family:Mitra;">پژوهش پیش‌رو از لحاظ روش‌شناسی، توصیفی </span></span><span style="color:black;"><span style="font-family:Mitra;">&ndash;</span></span><span style="color:black;"><span style="font-family:Mitra;"> تحلیلی حقوقی و از لحاظ هدف&shy;گذاری، یک مطالعه کاربردی محسوب می‌گردد و شیوه گردآوری داده‌ها، کتابخانه‌ای و اسنادی می‌باشد</span></span><span style="color:black;"><span style="font-family:Mitra;">.</span></span><br> <strong><span style="color:black;"><span style="font-family:Mitra;">ملاحظات اخلاقی:</span></span></strong> <span style="color:black;"><span style="font-family:Mitra;">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span></span><span style="color:black;"><span style="font-family:Mitra;"></span></span><br> <strong><span style="color:black;"><span style="font-family:Mitra;">یافته‌ها:</span></span></strong> <span style="color:black;"><span style="font-family:Mitra;">در پژوهش حاضر مشاهده خواهد شد که برای تحقق حقوق شهروندی و حقوق مهندسی در بخش ساختمان‌ نیاز به شناخت کافی نسبت به حقوق مهندسی و اصول فنی ساختمان و تعهد عملی کارفرماها و مهندسین به اجرای صحیح ساختمان‌ها و ضامن به تعهد آنها می‌باشد. در شرایطی که حقوق شهروندی و حقوق مهندسی در راستای پایداری به تعهد بین طرفین و انجام به موقع پروژه‌های ساختمانی و پرداخت به موقع هزینه‌ها رعایت گردد، نیاز به طرح دعاوی حقوقی در محافل قضایی نمی‌باشد</span></span><span style="color:black;"><span style="font-family:Mitra;">.</span></span><span style="color:black;"><span style="font-family:Mitra;"></span></span><br> <strong><span style="color:black;"><span style="font-family:Mitra;">نتیجه‌گیری:</span></span></strong> <span style="color:black;"><span style="font-family:Mitra;">از مهم‌ترین عوامل تأثیرگذار برای تحقق این مهم، فرهنگ&shy;سازی عمومی و آموزش همگانی و افزایش دانش حقوقی، در راستای احترام به قانون و حفظ حقوق شهروندی و </span></span><span style="color:black;"><span style="font-family:Mitra;">ارتقای کیفیت و افزایش عمر مفید در بخش ساختمان‌ و حقوق مهندسی </span></span><span style="color:black;"><span style="font-family:Mitra;">می‌باشد</span></span><span style="color:black;"><span style="font-family:Mitra;">.</span></span></span> <strong>Background and Aim</strong>: The purpose of the current study is to examine national building regulations, elaborate the duties and responsibilities of of design engineers, supervisors, executors according engineering laws and regulations.<br> <strong>Materials and Methods</strong>: The present research is applied research which employs descriptive-analytical methods for its purposes, the required data for which is collected from library archives.<br> <strong>Ethical Considerations:</strong> In all stages of authoring the present study, the originality and integrity of the contents and texts were maintained.<br> <strong>Findings:</strong> The findings of the study indicated that for implementing civil and engineering rights in the construction sector, being primarily equipped with sufficient knowledge on engineering rights, technical principles of the building and practical commitment of employers and engineers are of paramount significance in graceful construction of buildings and guaranteeing the commitment of the aforementioned parties. In case civil and engineering rights are implemented such that the commitment between the parties, the timely implementation of construction projects and due payment of costs are maintained, the grounds for filing lawsuits before courts are mitigated.<br> <strong>Conclusion:</strong> One of the most important influential factors for implementing civil and engineering rights is establishing the proper culture and public education for legal knowledge, with the purpose of respecting the law and protecting civil rights.
