fa تبیین و طراحی شیوه‌های فقهی و حقوقی نظارت بر موقوفات تخصصي Special پژوهشي Research <span style="font-size:14px;"><strong><span style="font-family:Mitra;">زمینه و هدف:</span></strong> <span style="font-family:Mitra;">در طول تاریخ، واقفان بر اساس یک سنت مقبول و مطلوب، ضمن انشای صیغه وقف، یک یا چند نفر را به‌عنوان متولی وقف تعیین می‌کردند که رسیدگی و اداره امور موقوفات توسط این افراد صورت می‌پذیرفت. بخشی از وظایف و اختیارات متولی تا حدودی در متن وقف‌نامه توسط واقفان تعیین می‌شد. لکن سایر اختیارات و وظایف متولیان وقف مسأله مهمی است که باید در عرصه‌های فقه و حقوق پیگیری و تبیین شود. لذا این سؤال پیش می‌آید که از منظر فقه و حقوق، متولیان وقف عام، چه وظایف و اختیاراتی دارند.</span><span style="font-family:Mitra;"> هدف از این تحقیق، واکاوی و ریشه‌یابی به منظور فراهم ساختن و برجسته کردن نظرات فقهی و حقوقی در خصوص حدود نظارت حکومت -که به نیابت به سازمان اوقاف و امور خیریه واگذار شده- و همچنین آسیب‌های موجود در جامعه و مدیریت متولیان بر موقوفات در حیطه عمل است</span><span style="font-family:Mitra;">.</span><br> <strong><span style="font-family:Mitra;">مواد و روش‌ها:</span></strong><span style="font-family:Mitra;"> این پژوهش یک </span><span style="font-family:Mitra;">مقاله توصیفی تحلیلی است.</span><span style="font-family:Mitra;"></span><br> <strong><span style="font-family:Mitra;">ملاحظات اخلاقی:</span></strong> <span style="font-family:Mitra;">ملاحظات اخلاقی در نگارش این پژوهش رعایت شده است.</span> <strong><span style="font-family:Mitra;"></span></strong><br> <strong><span style="font-family:Mitra;">یافته‌ها:</span></strong><span style="font-family:Mitra;"> بنا بر پژوهش صورت گرفته، متولی، وظیفه حفظ و نگهداری از موقوفات و متعلقات آن را دارد. همچنین موظف است املاکی را که برای نگهداری و مرمت موقوفات وقف شده به قیمت عادلانه اجاره دهد و در صورت مستهلک شدن اموال موقوفه آنها را تبدیل به احسن کند. اما تعیین امام جماعت در مساجد به نظر اکثر فقها از محدوده اختیارات متولی خارج است</span><span style="font-family:Mitra;">.</span><span style="color:black;"><span style="font-family:Mitra;"></span></span><br> <strong><span dir="RTL"><span style="font-family:Mitra;">نتیجه‌گیری:</span></span></strong> <span dir="RTL"><span style="font-family:Mitra;">متولی حق کنارگیری از سمت خود را ندارد و فقط می‌تواند وکیل بگیرد، به شرطی که واقف، مباشرت شخص او را شرط نکرده باشد</span></span><span dir="RTL"><span style="font-family:Mitra;">.</span></span></span> <strong>Background and Aim</strong>: Throughout history, waqfs, based on an accepted and desirable tradition, one or more people appointed as the trustee of the waqf, who took care of and managed the affairs of the endowment. Some of the duties and powers of the trustee were determined to some extent in the text of the endowment by the endowments. However, other powers and duties of the trustees of the endowment are important issues that should be pursued and explained in the fields of jurisprudence and law. The purpose of this research is to research and find jurisprudential and legal views on the limits of supervision - which is entrusted to the Endowment and Charity Organization.<br> <strong>Materials and Methods</strong>: This is a descriptive-analytical article.<br> <strong>Ethical Considerations</strong> All ethical considerations in writing this article have been observed.<br> <strong>Findings:</strong> According to the research, the trustee has the duty to maintain the endowments and their belongings. It is also obliged to rent the property that has been donated for the maintenance and restoration of the endowments at a fair price, and to convert the endowment property into a good one if it is depreciated. However, the appointment of the Imam of the congregation in mosques, according to most jurists, is beyond the authority of the trustee.<br> <strong>Conclusion:</strong> The trustee has no right to resign and can only hire a lawyer, provided the waqf does not stipulate her personal supervision. نظارت بر موقوفات, تولیت, وقف عام, فقه, حقوق.
