fa بررسی فقهی و حقوقی حکم قبض ثمن در پیش فروش بازار بورس کالا Jurisprudential and Legal Review of the Price Bill Ruling in the Pre-Sale of the Commodity Market تخصصي Special پژوهشي Research زمینه و هدف: یکی از اقسام معاملات رایج در بازار بورس، معامله پیش‌فروش است که علاوه بر تبعیت از قواعد عمومی قرادادها، دارای احکامی همچون ضرورت قبض تمام ثمن در مجلس عقد است که از مسائل مهم و اختلافی بین فقها می‌باشد. با توجه به پیش‌بینی این قرارداد، به عنوان یکی از سازوکارهای معاملات بورس کالا، رعایت شرایط و احکام خاص آن در این بازارها نیازمند به بررسی و تحلیل است. این پژوهش در صدد پاسخ به این سؤال است که آیا عدم‌قبض ثمن در بازار سنتی بویژه بورس کالا صحیح است؟ مواد و روش‌ها: روش تحقیق در این مقاله به‌صورت توصیفی بوده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: یکی از احکام قرارداد پیش‌فروش، قبض کل ثمن در مجلس عقد است که مورد اختلاف‌ نظر بین فقها است، که برخی از فقها معتقد به لزوم قبض ثمن در معامله پیش‌فروش و نیز تآثیر حکم قبض که در مالکیت کالا در معامله پیش‌فروش به‌ویژه در بازار بورس تبیین شده است. نتیجه‌گیری: با توجه به اهمّیّت تجارت در اسلام و همچنین رواج معامله پیش‌فروش در بازار بورس کالا، باید انطباق آن با قوانین فقه و حقوق اسلامی رعایت شود و لذا قبض در مالکیت معامله پیش‌فروش نقش ندارد.   Background and Aim: One of the common types of transactions in the stock market is pre-sale trading. In addition to following the general rules of contracts, it has rulings such as the need to receive the full price in the contract, which is one of the important issues and differences between jurists, according to the provisions of this contract, Its special provisions in these markets need to be examined and analyzed, and in this research it seeks to answer the question, whether the non-receipt of price in the traditional market, especially the commodity exchange, is correct? Materials and Methods: It is descriptive study. Ethical Considerations: All ethical considerations have been observed. Findings: One of the provisions of the pre-sale contract; the bill is the total price in the contract assembly, which is disputed among jurists. Some jurists believe in the necessity of receiving the price in the pre-sale transaction and also the effect of the bill that is explained in the ownership of the goods in the pre-sale transaction, especially in the stock market. Conclusion: Considering the importance of trade in Islam and also the prevalence of pre-sale transactions in the commodity exchange market, its compliance with the laws of Islamic jurisprudence and law must be observed and therefore the bill does not play a role in the ownership of the pre-sale transaction.   پیش‌فروش, بیع سلف, قبض ثمن, بورس کالا.
