fa تبیین فقهی- پزشکی خلأهای تقنینی مربوط به دیه عقل پژوهشي Research <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL"><span style="color:black;">عقل از بزرگترین نعمت‌های الهی به انسان است. شارع مقدس با</span></span> <span dir="RTL"><span style="color:black;">علم به این موضوع به منظور حفظ سلامت عقل، چتر حمایت خود را در برابر آسیب‌های متعدد جزئی و کلی وارد بر آن گسترانیده و برای صدماتی که موجب زوال آن می‌گردند دیه کامل و آنهایی که موجب نقصان عقل می‌گردند ارش را تعیین نموده است. به تبع، فصل پنجم از بخش دوم کتاب دیات در قانون مجازات اسلامی به مسائل پیرامون دیه عقل اختصاص یافته است. به نظر می‌رسد ضعف‌های جدی در بدنه نظام تقنینی کیفری ایران در این خصوص وجود دارد که محل تامل است و در کتب فقهی نیز به آن کمتر اشاره شده است. یکی از نصادیق خلاء مفهوم &laquo;عته&raquo; است. در تبیین این ماهیت می‌توان گفت اگرچه لفظ &laquo;عته&raquo; در برهه‌ای بین دوگانه مجنون و ناقص‌العقل دارای اشتراک لفظی بوده ولی بهترین حالت آن است که &laquo;عته&raquo; را چیزی غیر از جنون در نظر بگیریم. همینطور در تبیین جایگاه این مفهوم در بین اختلالات روانی شناخته شده، به‌دلیل عدم قطع ارتباط &laquo;معتوه&raquo; با واقعیات جهان پیرامونش و نیز توان نسبی اداره زندگی و عدم زوال کارکرد، در دسته نوروزها قرار می‌گیرد. همچنین در بحث قصاص در جنایات موجب زوال یا نقصان عقل، ادله گروهی که موافق اجرای قصاص در این قسم از جنایات هستند از ارجحیت برخوردار بوده و می‌توان قصاص در این جنایات را داخل در عمومات ادله قصاص قرار دارد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;">Wisdom (Aql) is one of god&rsquo;s blessings to man. In order to maintain the health of Wisdom, the holy legislator, supports against several minor and partial injuries to wisdom (Aql) and covers the damage by complete or partial Dia (blood money). Consequently, chapter five of the second part of the Islamic Penal Code is dedicated to the problems of wisdom (Aql). It seems that there are serious weaknesses in Iranian legislative criminal system in this regard which did not mentioned in the juridical books. One of the most important examples is the concept of &quot;Atah&rdquo;. Although the word &ldquo;Atah&rdquo; is common in a period between insane and Madness, but it does not mean insanity. Likewise, in explaining the position of this concept among mental disorders, due to the lack of interruptions in relation with the realities of the world around him as well as loss of function, it is placed in category of nervouses.
