fa کما از منظر فقه امامیه، پزشکی و حقوق کیفری ایران Coma from the Perspective of Imami Jurisprudence, Medicine and Iranian Criminal Law تخصصي Special پژوهشي Research زمینه و هدف: کما یک نوع اختلال در کارکرد مغز است که شخص دچار کاهش شدید سطح هوشیاری می‌گردد و مهم‌ترین مشخصه کما ناتوانی در هوشیار شدن فرد است؛ لذا فرد بیمار نمی‌تواند توسط محرک‌ها هوشیاری خود را به دست آورد؛ لذا لازم است مواد قانونی و دیدگاه‌های حقوقی و فقهی در خصوص نوع و میزان دیه مورد بررسی قرار گیرد. مواد و روش‌ها: روش تحقیق در این پژوهش توصیفی ـ تحلیلی و کتابخانه‌ای است. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در تقریر این مقاله رعایت شده است. یافته‌ها: یکی از چالش‌هایی که برای افرادی که در زندگی نباتی به سر می‌برند به وجود می‌آید، تعیین دیه، نوع و تعداد منافع زائل شده و پرداخت هزینه‌های ناشی از زندگی نباتی است. در زندگی نباتی فرد قادر به انجام اعمال ارادی نمی‌باشد؛ ولی دارای علائم حیاتی است. اغماء بیماری نیست، بلکه نشان از یک عارضه و صدمه به قوای دماغی دارد که منجر به ناهشیاری می‌شود. ناهشیاری این افراد ممکن است کوتاه مدت و یا طولانی مدت باشد. بر همین اساس از منظر فقهی و حقوقی هوشیار محسوب می‌گردند. افرادی که دچار این وضعیت می‌شوند ممکن است سال‌های متمادی زنده بمانند و هرچند به نظر هوشیار هستند اما با محیط اطراف خود نمی‌توانند ارتباطی برقرار کنند. نتیجه‌گیری: زندگی نباتی مرگ قطعی تلقی نمی‌شود و می‌توان برای هر یک از صدمات و منافع زائل شده بنابر نظر مشهور فقهای امامیه، مواد قانون مجازات اسلامی و قاعده عدم تداخل دیات، دیه و ارش جداگانه تعیین نمود.   Background and Aim: Coma is a type of brain dysfunction in which a person experiences a severe decrease in their level of consciousness, and the most important characteristic of coma is the inability to regain consciousness; therefore, the sick person cannot regain consciousness through stimuli; therefore, it is necessary to examine the legal provisions and legal and jurisprudential perspectives regarding the type and amount of blood money. Materials and Methods: The research method in this research is descriptive-analytical. Ethical Considerations: All ethical principles have been observed in the writing stages of this research. <h2 style="margin-right:2px; text-align:justify">Findings: One of the challenges for people in a vegetative state is determining the amount of compensation, the type and amount of benefits lost, and the payment of expenses incurred in the vegetative state. In a vegetative state, a person is unable to perform voluntary actions; but they have vital signs. Coma is not a disease, but rather a symptom of a complication and damage to the brain that leads to unconsciousness. The unconsciousness of these people may be short-term or long-term. Accordingly, from a jurisprudential and legal perspective, they are considered conscious. People who suffer from this condition may survive for many years and, although they appear to be conscious, cannot communicate with their surroundings.</h2> Conclusion: Vegetative life is not considered definitive death, and for each of the lost damages and benefits, according to the famous opinion of Imamiyyah jurists, the articles of the Islamic Penal Code, and the rule of non-interference of blood money, blood money, and blood money, separate determinations can be made.   کما, مرگ, حقوق کیفری.
