fa قتل عمد در سایه اختلالات روانی: آیا قانون 2009 انگلیس، مسیر درستی را درپیش گرفته است؟ Murder in the Shadow of The Mental Disorders: Has the UK's 2009 Law Taken the Right Path? تخصصي Special پژوهشي Research زمینه و هدف: این مقاله با هدف بررسی دفاع "مسؤولیت کاهش‌یافته" در نظام حقوقی انگلستان و تحلیل تأثیر اصلاحات قانون پزشکی قانونی و عدالت 2009 بر این دفاع ویژه و جزئی تدوین شده است. هدف اصلی تحقیق، تحلیل نحوه به‌کارگیری این دفاع در موارد قتل عمد و ارزیابی تأثیر شواهد پزشکی و وضعیت‌های روانی بر کاهش مسؤولیت متهم است. مواد و روش‌ها: روش تحقیق به صورت توصیفی-تحلیلی و بر پایه بررسی متون حقوقی، قوانین مرتبط و تحلیل پرونده‌های قضایی کلیدی از جمله پرونده‌های Byrne (1960)، Dietschmann (2003) و Wood (2008) انجام شده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها و نتیجه‌گیری: نتایج نشان می‌دهد که اصلاحات قانونی سال 2009، با ارائه تعریف دقیق‌تر از اختلال روانی و تأکید بر کاهش قابل‌توجه توانایی درک رفتار، اتخاذ تصمیم عقلانی و کنترل نفس، به شفاف‌سازی دفاع مسؤولیت کاهش‌یافته کمک کرده است. همچنین، تحلیل پرونده‌ها نشان می‌دهد که دادگاه‌ها همچنان در تفسیر و اعمال این دفاع با چالش‌هایی مانند تأثیر مستی خودخواسته و وابستگی به الکل مواجه هستند. نتیجه‌گیری این تحقیق نشان می‌دهد که دفاع مسؤولیت کاهش‌یافته نقش مهمی در تضمین عدالت کیفری و جلوگیری از صدور احکام ناعادلانه دارد. با این حال، نیاز به استانداردهای دقیق‌تر در ارزیابی شواهد پزشکی و روان‌پزشکی برای جلوگیری از سوءاستفاده از این دفاع در حقوق انگلیس همچنان احساس می‌شود.   Background and Aim: This paper aims to examine the "diminished responsibility" defense within the English legal system and analyze the impact of the Coroners and Justice Act 2009 reforms on this partial and special defense. The primary objective is to assess how this defense is applied in cases of murder and to evaluate the influence of medical evidence and mental conditions on the reduction of the defendant’s responsibility. Materials and Methods: The research methodology is descriptive-analytical, based on a review of legal texts, relevant statutes, and an analysis of key court cases, including Byrne (1960), Dietschmann (2003), and Wood (2008). Ethical Considerations: All ethical principles have been followed in writing this article. <div style="text-align: justify;">Findings & Conclusion: The findings reveal that the 2009 legal reform, by providing a clearer definition of mental disorder and emphasizing the substantial impairment of the ability to understand behavior, make rational judgments, and exercise self-control, has contributed to clarifying the diminished responsibility defense. However, the analysis of cases indicates that courts still face challenges in interpreting and applying this defense, especially concerning voluntary intoxication and alcohol dependency. The conclusion highlights that the diminished responsibility defense plays a vital role in ensuring criminal justice and preventing unfair sentencing. Nevertheless, the need for more precise standards in assessing medical and psychiatric evidence remains essential to prevent the misuse of this defense.</div> قتل غیرعمد ارادی,مسؤولیت کاهش یافته, نقص در عملکرد ذهنی,وضعیت پزشکی شناخته شده.
