fa مسؤولیت مدنی زوج در خشونت خانگی و آثار آن بر حقوق مالی زوجه تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:11pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><span lang="AR-SA" style="font-size:12.0pt"><span style="font-family:Mitra">خشونت خانگی به‌عنوان یکی از مصادیق نقض حقوق انسانی، آثار گسترده‌ای بر روابط خانوادگی و به‌ویژه حقوق مالی زوجه برجای می‌گذارد. در نظام حقوقی ایران، اگرچه مقررات صریح و جامعی درخصوص خشونت خانگی وجود ندارد، اما با اتکا به قواعد عام مسؤولیت مدنی، می‌توان مسؤولیت مدنی زوج را در قبال اعمال خشونت‌آمیز مورد بررسی قرار داد. این پژوهش با هدف تبیین مبانی مسؤولیت مدنی زوج در خشونت خانگی و تحلیل تأثیر آن بر حقوق مالی زوجه، ازجمله مهریه، نفقه، اجرت‌المثل ایام زوجیت و حق مطالبه خسارات مادی و معنوی، انجام شده است. روش تحقیق توصیفی - تحلیلی بوده و با بهره‌گیری از منابع فقهی، قانونی و رویه قضایی، ارکان تحقق مسؤولیت مدنی شامل فعل زیان‌بار، ورود ضرر و رابطه سببیت مورد واکاوی قرار گرفته است. یافته‌های پژوهش نشان می‌دهد که اعمال خشونت خانگی از سوی زوج می‌تواند به‌عنوان فعل نامشروع تلقی شده و زمینه مطالبه خسارت از سوی زوجه را فراهم آورد. همچنین خشونت خانگی در برخی موارد می‌تواند بر استحقاق یا تقویت حقوق مالی زوجه، به‌ویژه در دعاوی خانوادگی، تأثیرگذار باشد. درنهایت، این پژوهش بر ضرورت بازنگری در قوانین و پیش‌بینی مقررات حمایتی صریح به‌منظور حمایت مؤثر از زوجه در برابر خشونت خانگی تأکید می‌کند</span></span><span lang="FA" style="font-size:12.0pt"><span style="font-family:Mitra">.</span></span></span></span></span></span></span></span></div> <p lang="en"><strong>Domestic violence as a form of human rights violation has extensive effects on family relationships and, in particular, on the financial rights of the wife. Although the Iranian legal system lacks explicit and comprehensive regulations specifically addressing domestic violence, the husband&rsquo;s civil liability in relation to violent acts can be examined based on general civil liability principles. This study aims to clarify the foundations of the husband&rsquo;s civil liability in domestic violence and analyze its impact on the wife&rsquo;s financial rights, including the dowry (mahr), maintenance (nafaqa), compensation for services during marriage (ujrat al-mithl), and the right to claim material and immaterial damages. The research method is descriptive-analytical and utilizes jurisprudential, legal, and judicial sources to examine the elements of civil liability: harmful act, damage, and causal relationship. The findings indicate that domestic violence by the husband can be deemed an unlawful act and provide grounds for the wife to claim compensation. Additionally, domestic violence may, in certain cases, affect the entitlement to or strengthening of the wife&rsquo;s financial rights, especially in family law disputes. Ultimately, the study underscores the necessity of revising laws and enacting explicit protective regulations to effectively safeguard the wife against domestic violence.</strong></p> <p lang="en"></p> مسؤولیت مدنی, زوج, خشونت خانگی, حقوق مالی زوجه.
