fa نقش پلیس فتا و کارشناسان رسمی در اعتبار ادله الکترونیکی تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="AR-SA" style="font-family:&quot;B Mitra&quot;">گسترش فناوری‌های اطلاعاتی و وابستگی روزافزون نظام عدالت کیفری به داده‌ها و شواهد دیجیتال، ادله الکترونیکی را به یکی از مهم‌ترین ابزارهای اثبات در دادرسی کیفری تبدیل کرده است. بااین‌حال، ماهیت ناملموس، تغییرپذیر و آسیب‌پذیر این ادله، خطر تحریف، حذف، دست‌کاری یا گسست در زنجیره حفاظت را افزایش داده و ضرورت بهره‌گیری از سازوکارهای تخصصی برای تضمین اصالت، تمامیت و قابلیت استناد آن‌ها را آشکار ساخته است. پژوهش حاضر با هدف تبیین نقش پلیس فتا و کارشناسان رسمی دادگستری در اعتباربخشی به ادله الکترونیکی و شناسایی چالش‌های حقوقی و فنی حاکم بر فرایند کشف، جمع‌آوری، ثبت، مستندسازی، نگهداری و ارزیابی این ادله انجام شده است. روش پژوهش توصیفی ـ تحلیلی و مبتنی بر مطالعه منابع کتابخانه‌ای، قوانین موضوعه، اسناد حقوقی و پژوهش‌های علمی مرتبط است و داده‌ها با رویکردی تلفیقی در حوزه حقوق و فناوری تحلیل شده‌اند. یافته‌ها نشان می‌دهد پلیس فتا در مرحله کشف جرم، شناسایی منابع داده، توقیف و استخراج اطلاعات و حفظ زنجیره نگهداری، نقشی بنیادی دارد؛ در مقابل، کارشناسان رسمی دادگستری از طریق ارزیابی فنی، تشخیص اصالت و تمامیت داده‌ها، تحلیل فراداده‌ها و بررسی احتمال دست‌کاری، نقش تکمیلی و تخصصی ایفا می‌کنند. با وجود این، فقدان استانداردهای ملی یکپارچه، ناهماهنگی نهادی، کمبود نیروی متخصص، ضعف آموزش‌های حرفه‌ای و ناآشنایی برخی مقامات قضایی با اقتضائات ادله دیجیتال، کارآمدی این فرایند را محدود می‌سازد. نتیجه آن‌که ارتقای اعتبار ادله الکترونیکی مستلزم تدوین پروتکل‌های ملی، تقویت همکاری ساختاریافته میان پلیس فتا و کارشناسان رسمی، توسعه آموزش‌های تخصصی، ارتقای سواد فناورانه قضات و ایجاد نظام نظارت کیفی مستمر است</span>.</span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><i>The expansion of information technologies and the growing reliance of criminal justice systems on digital data have made electronic evidence a central means of proof in criminal proceedings. Yet its intangible, mutable, and vulnerable nature exposes it to alteration, deletion, manipulation, and disruption of the chain of custody, thereby requiring specialized mechanisms to ensure authenticity, integrity, and admissibility. This study examines the role of the Iranian Cyber Police (FATA) and official court-appointed experts in validating electronic evidence and identifies the principal legal and technical challenges affecting its detection, collection, documentation, preservation, and evaluation. Using a descriptive-analytical method, the research draws on library sources, statutory provisions, legal instruments, and relevant scholarly literature, analyzed through an interdisciplinary legal and technological approach. The findings show that FATA plays a fundamental role in crime detection, identification of digital sources, seizure and extraction of data, and preservation of the chain of custody. Official experts perform a complementary and specialized function by conducting technical examinations, verifying data authenticity and integrity, analyzing metadata, and detecting manipulation. However, the lack of unified national standards, institutional fragmentation, shortages of qualified personnel, insufficient professional training, and limited technological literacy among some judicial authorities reduce the effectiveness of this process.
