fa الأساس القانونی والعوامل المؤدیه إلی تحول أفغانستان إلی مرکز عالمی لتهریب المخدرات تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="AR-EG" style="font-size:14.0pt"><span style="line-height:115%"><span arabic="" style="font-family:" traditional=""><span style="color:black">تُعد ظاهره تهریب المخدرات من أخطر صور الجریمه المنظمه العابره للحدود، لما تفرضه من تحدیات قانونیه وأمنیه واقتصادیه تمس استقرار الدول والمجتمع الدولی. وقد تطورت هذه الظاهره من نشاط إجرامی محدود إلی شبکه دولیه معقده تعتمد علی التنظیم والتمویل والتکنولوجیا الحدیثه، مما جعلها ترتبط بجرائم غسل الأموال والاتجار بالبشر وتمویل الجماعات المسلحه والإرهاب. وتبرز أفغانستان بوصفها الحاله الأکثر تعقیدًا فی هذا المجال، إذ ارتبط اسمها لعقود بإنتاج الأفیون وتصدیره إلی الأسواق العالمیه، الأمر الذی جعلها محورًا رئیسیًا فی تجاره المخدرات غیر المشروعه. ولا یمکن تفسیر تحول أفغانستان إلی مرکز عالمی لتهریب المخدرات بالاعتماد علی عامل واحد، بل هو نتیجه تفاعل عوامل سیاسیه وأمنیه واقتصادیه واجتماعیه وجغرافیه، إلی جانب ضعف المؤسسات الحکومیه واستمرار النزاعات المسلحه. وقد أدی ذلک إلی ترسیخ اقتصاد غیر مشروع یعتمد بصوره کبیره علی زراعه الخشخاش وإنتاج الأفیون، مما انعکس بصوره مباشره علی الأمن الإقلیمی والدولی. ومن الناحیه القانونیه، أدرک المجتمع الدولی مبکرًا خطوره هذه الظاهره، فاعتمد مجموعه من الاتفاقیات الدولیه التی هدفت إلی تنظیم تداول المواد المخدره وقصر استخدامها علی الأغراض الطبیه والعلمیه، مع إلزام الدول بتجریم الاتجار غیر المشروع بها وتعزیز التعاون الدولی لمکافحته. وتأتی أهمیه هذا المبحث فی بیان المفاهیم القانونیه المتعلقه بالمخدرات، وتحلیل الأسباب التی جعلت أفغانستان مرکزًا عالمیًا لهذه التجاره، مع استعراض أهم الأطر القانونیه الدولیه التی تنظم مکافحتها.</span></span></span></span></span></span></span></span></span><br> &nbsp; <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:472px; padding:0cm 7px 0cm 7px; height:124px"><span style="font-size:11pt"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span lang="EN" style="font-size:12.0pt"><span new="" roman="" style="font-family:" times="">Drug trafficking is one of the most perilous forms of transnational organized crime, posing significant legal, security, and economic challenges that threaten the stability of nations and the international community. This phenomenon has evolved from a limited criminal activity into a complex international network leveraging modern organization, finance, and technology, thereby becoming intrinsically linked to money laundering, human trafficking, and the financing of terrorism and armed groups. Afghanistan stands out as the most complex case in this domain; its association with opium production and export for decades has positioned it as a central hub for the illicit drug trade. Afghanistan&rsquo;s transformation into a global drug trafficking hub cannot be attributed to a single factor but is rather the result of an interplay of political, security, economic, social, and geographical determinants, compounded by weak state institutions and protracted armed conflict. This has entrenched an illicit economy heavily reliant on poppy cultivation and opium production, with direct ramifications for regional and international security. From a legal perspective, the international community recognized the gravity of this phenomenon early on, adopting several international conventions aimed at regulating the circulation of narcotic substances, restricting their use to medical and scientific purposes, and mandating that states criminalize illicit trafficking and strengthen international cooperation to combat it. This research clarifies the legal concepts surrounding narcotics, analyzes the factors that have rendered Afghanistan a global hub for this trade, and reviews the primary international legal frameworks governing counter-narcotics efforts.</span></span></span></span></span></td> </tr> </tbody> </table> الترهیب, المخدرات, افغانستان.
