fa استقلال قضایی در فرآیند صدور، نظارت و کنترل قضایی احکام کیفری تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="FA" style="font-size:12.0pt"><span style="line-height:115%"><span style="font-family:Mitra">استقلال قضایی از الزامات اساسی دادرسی عادلانه و از مهم‌ترین تضمین‌های قانون‌مداری در فرایند کیفری است؛ بااین‌حال، استقلال قاضی نباید به معنای مصونیت مطلق تصمیم قضایی از نظارت و کنترل قانونی تلقی شود. مسأله اصلی پژوهش، تبیین حدود استقلال قاضی در فرآیند صدور، نظارت و کنترل احکام کیفری و بررسی چگونگی جمع میان استقلال قضایی، نظارت قانونی و ضرورت پاسخگویی قضایی است. پژوهش حاضر با هدف تبیین مبانی و حدود استقلال قضایی در صدور احکام کیفری، بررسی حدود مداخله مراجع بالاتر در کنترل آراء، تبیین نقش دیوان عالی کشور در تضمین قانون‌مداری و شناسایی عوامل تحدیدکننده استقلال قاضی و آثار آن بر کیفیت احکام کیفری انجام شده است. روش تحقیق، توصیفی ـ تحلیلی و شیوه گردآوری داده‌ها کتابخانه‌ای است و با بررسی قوانین و مقررات مرتبط، منابع حقوقی و آثار علمی موجود، ابعاد مختلف استقلال قضایی در فرایند کیفری تحلیل شده است. یافته‌های پژوهش نشان می‌دهد استقلال قضایی و نظارت قضایی، در صورت رعایت حدود صلاحیت قانونی، دو اصل متعارض نیستند، بلکه مکمل یکدیگرند. استقلال قاضی مستلزم مصونیت وی از مداخلات غیرقضایی و فشارهای مؤثر بر تصمیم‌گیری است، درحالی‌که نظارت مراجع بالاتر باید در چهارچوب صلاحیت قانونی و با هدف کنترل رعایت قانون، اصلاح خطاهای قضایی و تضمین انسجام رویه اعمال شود. همچنین، تحدید غیرقانونی استقلال قضایی می‌تواند بی‌طرفی قاضی، کیفیت استدلال، انسجام آراء، حقوق دفاعی و اعتماد به فرایند دادرسی کیفری را تحت تأثیر قرار دهد. بر این اساس، تحقق دادرسی عادلانه مستلزم ایجاد توازن میان استقلال قاضی، نظارت قانونی و پاسخگویی قضایی است.</span></span></span></span></span></span></span></span></span><br> &nbsp; <span style="font-size:11pt"><span style="line-height:115%"><span style="unicode-bidi:embed"><span sans-serif="" style="font-family:Calibri,"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Judicial independence is a fundamental requirement of a fair trial and a key guarantee of the rule of law in criminal proceedings. However, it does not imply absolute immunity of judicial decisions from legal supervision and review. This study examines the scope of judicial independence in issuing, supervising, and reviewing criminal judgments and explores its relationship with legal oversight and judicial accountability. The study aims to clarify the foundations and limits of judicial independence, examine the scope of intervention by higher judicial authorities, explain the role of the Supreme Court in ensuring compliance with the law, and identify factors that restrict judicial independence and affect the quality of criminal judgments. The research employs a descriptive-analytical method and relies on library-based data collection. Relevant laws, regulations, legal sources, and scholarly literature were examined to analyze different aspects of judicial independence in criminal proceedings. The findings indicate that judicial independence and judicial oversight, when exercised within legally defined boundaries, are complementary rather than conflicting principles. Judicial independence protects judges from non-judicial interference and external pressures, while oversight by higher judicial authorities should remain within their statutory powers and primarily serve to ensure legal compliance, correct judicial errors, and promote consistency in judicial practice. Unlawful restrictions on judicial independence may adversely affect judicial impartiality, the quality of legal reasoning, consistency of judgments, defendants&rsquo; rights, and public confidence in criminal justice.
