fa الاساس الدستوری لمبدا العداله فی توزیع الثروات فی العراق و الجزائر تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="AR-IQ" style="font-size:13.0pt"><span style="line-height:115%"><span style="font-family:&quot;Traditional Arabic&quot;,serif">یعد مبدأ العداله فی توزیع الثروات من المبادئ الدستوریه ذات الصله المباشره بفکره الدوله الحدیثه&nbsp; إذ لم یعد الدستور مجرد وثیقه لتنظیم السلطات العامه وتحدید اختصاصاتها&nbsp; بل أصبح إطارًا قانونیًا لضمان الحقوق والحریات&nbsp; وتحقیق التوازن الاجتماعی والاقتصادی&nbsp; وتوجیه السیاسات العامه نحو توزیع الموارد والثروات بصوره منصفه بین الأفراد والمناطق والأجیال&nbsp; ومن هذا المنطلق&nbsp; تبرز أهمیه دراسه هذا المبدأ فی الدستورین العراقی والجزائری&nbsp; بالنظر إلی ما یمتلکه البلدان من ثروات طبیعیه واقتصادیه مهمه&nbsp; ولا سیما النفط والغاز وما یثیره تنظیم هذه الثروات وإدارتها وتوزیع عوائدها من إشکالات دستوریه وقانونیه وعملیه حیث ان ان النصوص الدستوریه فی کل من العراق والجزائر قد ارست اساسا قانونیا لتکریس مبدا العداله فی توزیع الثروات الا ان فاعلیه هذا المبدأ تتفاوت بین البلدین تبعا لاختلاف الاطار الدستوری&nbsp; والتشریعی والمؤسسی والیات الرقابه وتأثیر التحدیات السیاسیه والاقتصادیه والاداریه فی التطبیق العلمی .</span></span></span></span></span></span></span></span></span></span><br> &nbsp; <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:472px; padding:0cm 7px 0cm 7px; height:124px"><span style="font-size:11pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;Times New Roman&quot;,serif">The principle of equitable wealth distribution is a constitutional principle directly related to the concept of the modern state. A constitution is no longer merely a document for regulating public authorities and defining their jurisdictions; it has become a legal framework for guaranteeing rights and freedoms, achieving social and economic balance, and guiding public policies toward the equitable distribution of resources and wealth among individuals, regions, and generations. From this perspective, the importance of studying this principle in the Iraqi and Algerian constitutions becomes clear, given the significant natural and economic resources both countries possess, particularly oil and gas, and the constitutional, legal, and practical challenges arising from regulating, managing, and distributing the revenues from these resources. While the constitutional texts in both Iraq and Algeria have established a legal basis for enshrining the principle of equitable wealth distribution, the effectiveness of this principle varies between the two countries depending on differences in their constitutional, legislative, and institutional frameworks, oversight mechanisms, and the impact of political, economic, and administrative challenges on its practical application.</span></span></span></span></span></span></td> </tr> </tbody> </table> العداله , توزیع الثروات , الآلیات المؤسسیه.
