fa الحمایه القضائیه لحقوق المواطنین تجاه القرارات الإداریه الفردیه: دراسه مقارنه بین العراق ومصر تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><span lang="AR-SA" style="font-size:12.0pt"><span style="font-family:&quot;Traditional Arabic&quot;,serif">تعد الرقابه القضائیه الضمانه الجوهریه لحمایه حقوق المواطنین من تعسف الإداره وانحرافها فی إصدار القرارات الإداریه الفردیه. تهدف هذه الدراسه إلی تحلیل فاعلیه التدخل القضائی فی فحص أرکان القرار (الاختصاص، الشکل، السبب، المحل، والغایه) وإلغاء ما شابه من عیب، انسجاماً مع فرضیه الانتقال بالضمانات من الشکلیه إلی الجوهریه. وتعتمد الدراسه منهجاً مقارنه بین النظامین العراقی والمصری اللذین یؤسسان لمبدأ خضوع الإداره للقضاء عبر جهازین قضائیین متخصصین. وتکشف المقارنه عن تباین ملحوظ بین النظامین فی مدی شمولیه الرقابه والاستقلال المؤسسی وسرعه الإجراءات ومدی استجابتها للتحدیات المعاصره. وتخلص الدراسه إلی تقییم نقدی لفاعلیه کلا النظامین فی تحقیق العداله الإداریه مما یؤکد الحاجه الملحه لتطویر الآلیات القضائیه لضمان حمایه فعلیه وحدیثه لحقوق الأفراد تجاه التصرفات الإداریه. </span></span></span></span></span></span><br> &nbsp; <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:472px; padding:0cm 7px 0cm 7px; height:277px"><span style="font-size:11pt"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;Times New Roman&quot;,serif">Judicial review constitutes the substantive guarantee for protecting citizens&#39; rights against administrative abuse and deviation in issuing individual administrative decisions. This study aims to analyze the effectiveness of judicial intervention in examining a decision&#39;s elements (competence, form, reason, subject, and purpose) and annulling flawed ones, aligning with the hypothesis of transitioning guarantees from formal to substantive. It employs a comparative approach between the Iraqi and Egyptian systems, highlighting the role of their specialized judicial bodies in subjecting the administration to justice. The comparison reveals notable discrepancies in the comprehensiveness of review, institutional independence, procedural speed, and responsiveness to contemporary challenges.
