fa الحق فی الجنسیه وأثره فی حمایه حقوق الإنسان فی العراق دراسه فی ضوء التشریع العراقی تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="AR-SA" style="font-size:14.0pt"><span style="line-height:115%"><span style="font-family:&quot;Traditional Arabic&quot;,serif">یتناول هذا البحث ضوابط الجنسیه فی العراق وأثرها فی حمایه حقوق الإنسان، من خلال بیان التطور التاریخی والتشریعی لتنظیم الجنسیه العراقیه، وموقف المشرّع العراقی من اکتساب الجنسیه وفقدانها واستردادها، ومدی توافق هذه الضوابط مع مبادئ المساواه وعدم التمییز والحق فی الجنسیه. کما یتناول البحث التحولات التی شهدها النظام القانونی للجنسیه بعد عام 2003، ولا سیما فی ظل دستور جمهوریه العراق لسنه 2005 وقانون الجنسیه العراقیه رقم (26) لسنه 2006، وما تضمناه من ضمانات تهدف إلی حمایه المرکز القانونی للفرد ومنع حالات الحرمان التعسفی من الجنسیه. کذلک یبحث البحث فی أهم المؤسسات والآلیات التی تسهم فی حمایه حقوق الإنسان المرتبطه بالجنسیه، وفی مقدمتها القضاء والمفوضیه العلیا لحقوق الإنسان والرقابه البرلمانیه والمجتمعیه. ویخلص البحث إلی أن التشریع العراقی الحدیث حقق تطوراً ملحوظاً فی مجال حمایه الحق فی الجنسیه، إلا أن فاعلیه هذه الضمانات تظل مرتبطه بسلامه التطبیق العملی وفعالیه الرقابه القضائیه والإداریه.</span></span></span></span></span></span></span></span><br> &nbsp; <span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span style="font-family:&quot;Times New Roman&quot;,serif">This research examines the regulations governing nationality in Iraq and their impact on the protection of human rights. It addresses the historical and legislative development of Iraqi nationality law, the rules governing the acquisition, loss, and restoration of nationality, and the extent to which these rules comply with the principles of equality, non-discrimination, and the right to nationality. The research also examines the legal developments that took place after 2003, particularly under the Iraqi Constitution of 2005 and the Iraqi Nationality Law No. 26 of 2006, which introduced important safeguards aimed at protecting the individual&#39;s legal status and preventing arbitrary deprivation of nationality. Furthermore, the study discusses the main Institutions and mechanisms contributing to the protection of human rights related to nationality, particularly the judiciary, the High Commission for Human Rights, parliamentary oversight, and societal oversight.
