fa راهکارهای مبارزه با جرم قاچاق انسان، مطالعه تطبیقی در حقوق عراق و قوانین بین‌المللی تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="AR-IQ" style="font-family:Mitra"><span style="color:black">تلاش‌های بین‌المللی برای پایه گذاری مبانی قانونی مبارزه با قاچاق انسان از راه کنوانسیون سازمان ملل متحد درباره مبارزه با جرایم سازمان یافته فراملی مصوب سال 2000 و پروتکل تکمیلی آن، موسوم به پروتکل پالرمو، صورت گرفته است. این پروتکل مفهوم قانونی قاچاق اشخاص را مشخص کرده و تعهدات کشورهای عضو را در زمینه جرم انگاری، پیشگیری، حمایت و همکاری بین‌المللی روشن ساخته است. عراق نیز در سطح ملی کوشیده است تعهدات بین‌المللی خود را با تصویب قانون مبارزه با قاچاق انسان به شماره 28 سال 2012 اجرایی کند. تصویب این قانون گامی مهم در مبارزه داخلی با این جرم به شمار می رود. پژوهش حاضر با هدف شناخت مفهوم جرم قاچاق انسان و ارکان آن، همچنین شناسایی راهکارهای مبارزه با این جرم در دو سطح بین‌المللی و ملی انجام شده است. پژوهشگر متناسب با ماهیت موضوع از روش توصیفی تحلیلی بهره گرفته است. در پایان پژوهش، نتایجی به دست آمد که مهم‌ترین آنها ضرورت به روزرسانی قانون شماره 28 سال 2012 عراق برای مقابله با شیوه های نوین ارتکاب جرم است. از مهم ترین پیشنهادها نیز فعال سازی کمیته ملی مبارزه با قاچاق انسان و تقویت منابع انسانی و مالی آن است.</span></span></span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif">&nbsp;&nbsp;&nbsp; <span lang="EN" style="font-size:11.0pt"><span style="color:black">International efforts have laid the legal foundations for combating human trafficking, through the United Nations Convention against Transnational Organized Crime of 2000 and its additional protocol known as the &quot;Palermo Protocol,&quot; which defined the legal concept of human trafficking and the obligations incumbent upon States Parties in terms of criminalization</span></span><span style="font-size:11.0pt"><span style="color:black">,</span></span> <span lang="EN" style="font-size:11.0pt"><span style="color:black">Prevention, protection, and international cooperation. At the national level, Iraq has worked to translate its international obligations in this field by enacting the Anti-Human Trafficking Law No. (28) of 2012, which is an important step towards combating this crime locally. The research aimed to identify the concept of the crime of human trafficking and its elements.</span></span><span style="font-size:11.0pt"><span style="color:black">,</span></span> <span lang="EN" style="font-size:11.0pt"><span style="color:black">The study also aimed to identify ways to combat human trafficking at both the international and national levels. The researcher used the descriptive-analytical method, which was appropriate to the nature of the research title.
