fa قلمرو حقوق حاکمه دولت ساحلی در منطقه فلات قاره تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra">زمینه و هدف:</span></b> <span lang="FA" style="font-family:Mitra">کنوانسیون حقوق دریاهای سازمان ملل 1982 به‌عنوان شروع عصری جدید درزمینه حقوق بین‌الملل دریاها تلقی می‌شود. یکی از مهم‌ترین اموری که در این سند به آن پرداخته‌شده مسأله تعیین مناطق مختلف دریایی است که در این میان فلات قاره، تحدید حدود آن و حقوق دولت ساحلی در این منطقه از اهمیت خاصی برخوردار است. این مقاله با نگاهی به حقوق حاکمه کشور ساحلی در فلات قاره (اعم از فلات قاره 200 مایلی و فلات قاره ماوراء 200 مایل) قلمرو این حقوق را مشخص می‌کند و درنهایت به این سؤال پاسخ دهد که چگونه وظایف کشور ساحلی در قبال کشورهای ثالث و جامعه جهانی می‌تواند قلمرو حقوق حاکمه این کشور را محدود کند.</span><span lang="AR-SA" style="font-family:Mitra"></span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra">مواد و روش‌ها:</span></b><span lang="AR-SA" style="font-family:Mitra"> روش تحقیق در این مقاله به‌صورت توصیفی بوده است.</span></span></span></span></span></span><br> <span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA" style="font-family:Mitra">ملاحظات اخلاقی:</span></b><span lang="AR-SA" style="font-family:Mitra"> تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است.</span></span></span></span><br> <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="text-autospace:none"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra">یافته‌ها</span></b><b><span lang="FA" style="font-family:Mitra"> و </span></b><b><span lang="AR-SA" style="font-family:Mitra">نتیجه‌گیری:</span></b> <span lang="FA" style="font-family:Mitra">ماده 76 کنوانسیون به نحوی جامع عناصر تشکیل‌دهنده یک فلات قاره حقوقی، فرمول دقیق تحدید حدود فلات قاره و فرآیند انجام آن و سایر جزئیات لازم را دربرمی گیرد. اگرچه در این سند بستر و زیر بستر دریا در محدوده 200 مایلی از خط مبدأ ساحلی تحت عنوان فلات قاره به‌صورت ذاتی متعلق به کشور ساحلی است، بااین‌حال تحت شرایط مقرر در کنوانسیون کشور ساحلی می‌تواند ادعای خود را نسبت به فلات قاره به فراتر از این فاصله گسترش دهد. کنوانسیون 1982 حقوق حاکمه را برای کشور ساحلی درزمینه اکتشاف و بهره‌برداری از منابع طبیعی فلات قاره قائل شده است و این امر مربوط به بستر و زیر بستر دریا در محدوده مشخص‌شده است بااین‌حال دولت ساحلی وظایفی نیز در قبال سایر کشورها و جامعه جهانی در رابطه با اعمال حقوق حاکمه خود در این منطقه دارد.</span><span lang="AR-SA" style="font-family:Mitra"></span></span></span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:11.0pt"><span style="color:#002060">Background and Aim</span></span></b><span style="font-size:11.0pt">:</span> <span style="font-size:11.0pt">United Nations Convention on Law of the Seas 1982 is considered as a beginning of new era in international law of the seas. Even though in this document seabed and sub soil in the distance of 200 M from coastal baseline is inherent to the coastal country, however this country may extend its continental shelf beyond 200 M according to the requirements of the Convention. 1982 Convention recognizes sovereignty rights for coastal country in continental shelf which is related to seabed and subsoil however this country has some obligation toward other countries and international community as a whole.</span></span></span></span> فلات قاره, حقوق حاکمه, حقوق دریاها, کنوانسیون 1982.
