fa درآمدی بر جلوه‌های پیشگیری مشارکتی کنشی و واکنشی در سیاست جنایی ایران An Introduction to the Effects of Active and Reactive Participatory Prevention in Iran’s Criminal Policy تخصصي Special پژوهشي Research زمینه و هدف: سیاست جنایی مشارکتی به عنوان یک سیاست جنایی همراه با مشارکت جامعه مدنی تعریف شده است که در چارچوب آن در کنار دیگر نهادهای عدالت کیفری از جمله پلیس و دستگاه قضایی، با استفاده از نهادهای وابسته به جامعه مدنی نیز سعی در سامان بخشیدن به پدیده مجرمانه دارد. بحثی نیست که رگه‌های سیاست جنایی مشارکتی را باید در آموزه‌های بازمانده از پیشینیان که در بستر گذار و تحول جوامع به وجود آمده‌اند، جستجو کرد اما در سال‌های اخیر در پرتو مکاتب نوین جرم شناسی از جمله نظریات واکنش اجتماعی و در جهت یافته‌های جرم شناسی حقوقی به عنوان شاخه‌ای از جرم‌شناسی کاربردی، رویکرد دولت‌ها در مشارکت مردم در پدیده مجرمانه دست خوش تغییراتی شده است. توضیح آن‌که امروزه مشارکت مردم در نهادهای عدالت کیفری برای پیشگیری از پدیده بزهکاری، جنبه پیشینی (مرحله پیش از وقوع جرم) و پسینی (پس از وقوع جرم) را به شکلی نظام‌مند و کارآمد در برمی‌گیرد. بر همین اساس، این پژوهش با هدف بررسی جلوه‌های پیشگیری مشارکتی، در صدد پاسخ به این سؤال که جلوه‌های پیشگیری مشارکتی کنشی و واکنشی در سیاست جنایی ایران کدام است، برآمده است. مواد و روش‌ها: روش تحقیق در این مقاله به صورت توصیفی- تحلیلی بوده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها و نتیجه‌گیری: نتایج نشان داد که سیاست تقنینی ایران به خصوص در قانون آیین دادرسی کیفری مصوب 1392 با اصلاحات بعدی و قانون پیشگیری از وقوع جرم مصوب 1394، جلوه‌هایی از مشارکت جامعه مدنی را در امر پیشگیری مشارکتی کنشی و واکنشی، مورد پذیرش قرار داده است.   Background and Aim: Participatory criminal policy has been defined as a criminal policy that involves the participation of civil society, within which, attempts are made to address criminal phenomena using community-based organizations in company of other criminal justice institutions such as the police and the judiciary. There is no doubt that traces of participatory criminal policy should be sought in the lessons of predecessors that have emerged in the context of the establishment and transformation of societies, but in recent years, in the light of modern criminological schools such as social reaction theories and the achievements of legal criminology, as a branch of applied criminology, the approach of governments towards involving people in criminal phenomena has undergone significant changes. It should be said that, today, people's participation in criminal justice institutions includes a systematic and effective approach to both the preventive (pre-crime) and reactive (post-crime) aspects of crime prevention. According to this fact, this research aims to investigate the prevention aspects of participatory crime prevention, in an attempt to answer the question of which aspects of participatory prevention are active and reactive in <st1:country-region w:st="on"><st1:place w:st="on">Iran</st1:place></st1:country-region>'s criminal policy. Materials and Methods: The research method in this article was descriptive-analytical. Ethical Considerations: All ethical principles have been followed in writing this article. Findings & Conclusion: The results show that <st1:country-region w:st="on"><st1:place w:st="on">Iran</st1:place></st1:country-region>'s legislative policy, especially in the Code of Criminal Procedure approved in 2013 with subsequent amendments and the Crime Prevention Law approved in 2015, has accepted aspects of civil society participation in active and reactive participatory prevention.   پیشگیری مشارکتی, پیشگیری کنشی, پیشگیری واکنشی, پیشگیری اجتماعی.
