fa مقررات حاکم بر منابع آبی مشترک در حقوق بین‌الملل Regulation of Shared Water Resources in International Law تخصصي Special پژوهشي Research زمینه و هدف: آب به‌عنوان یک منبع حیاتی برای بقای انسان و سایر جانداران، در دنیای معاصر به یکی از چالش‌های اصلی تبدیل شده است. باتوجه‌به تغییرات اقلیمی و رشد روزافزون نیاز به آب، این مقاله به بررسی مقررات حاکم بر منابع آبی مشترک در حقوق بین‌الملل می‌پردازد. به‌ویژه، تمرکز این تحقیق بر تحلیل کنوانسیون 1997 سازمان ملل در خصوص مدیریت آب‌های بین‌المللی و چالش‌های موجود در مدیریت منابع آبی مشترک است. مواد و روش‌ها: روش مطالعه و گردآوری اطلاعات و یافته‌های پژوهش اصلی، تحلیلی توصیفی بوده است. ملاحظات اخلاقی: کلیه اصول اخلاقی حاکم در پژوهش، در ترجمه این مقاله رعایت شده است. یافته‌ها: مطالعه‌ انجام‌شده نشان می‌دهد که کنوانسیون 1997 سازمان ملل در زمینه آبراهه‌های بین‌المللی بیشتر بر مدیریت نیازهای کشورهای ساحلی متمرکز است و به موضوعات مهمی چون زیست‌محیطی بودن و پایداری منابع آبی توجه کافی ندارد. همچنین، معاهدات موجود بین کشورهای ساحلی، به‌ویژه در مورد هند و بنگلادش، فاقد برنامه‌های بلندمدت برای بهبود کیفیت و کمیت منابع آبی هستند. این مقاله همچنین بیان می‌کند که نیاز به تغییر رویکرد از «مدیریت نیازها» به «مدیریت منابع» احساس می‌شود. نتیجه‌گیری: نتایج این تحقیق به وضوح نشان می‌دهد که حقوق بین‌الملل باید به سمت مدیریت پایدار منابع آبی حرکت کند. همچنین، لازم است که کنوانسیون 1997 مورد بازنگری قرار گیرد تا به‌عنوان یک چارچوب جامع برای استفاده بهینه و منصفانه از منابع آبی بین‌المللی عمل کند. پیشنهاد می‌شود که جامعه بین‌المللی اسناد جدیدی را برای حل چالش‌های موجود در مدیریت منابع آبی ایجاد کند تا به‌طور مؤثری منازعات و مشکلات مربوط به منابع آبی مشترک را حل‌وفصل کند.   Background and Aim: Water, as a vital resource for the survival of humans and other living organisms, has become one of the primary global challenges in the contemporary world. In light of climate change and the growing demand for water, this article examines the regulations governing shared water resources in international law. In particular, it focuses on analyzing the 1997 United Nations Convention on the management of international waters and the challenges inherent in managing shared water resources. Materials and Methods: This is a descriptive study. Ethical Considerations: All ethical principles governing research have been observed in the presentation of this Translation. Findings: The study reveals that the 1997 Convention primarily concentrates on the management of the needs of riparian states, while giving insufficient attention to crucial issues such as environmental sustainability and the long-term preservation of water resources. Moreover, existing treaties among riparian states, particularly those between India and Bangladesh, lack long-term plans for improving the quality and quantity of water resources. The paper concludes that there is a critical need to shift the approach from "needs management" to "resource management." Conclusion: The findings clearly indicate that international law must move towards sustainable water resource management. Additionally, the 1997 Convention needs revision in order to serve as a comprehensive framework for the fair and efficient use of shared water resources.
