fa تحول مفهوم مجازات در سیاست جنایی ایران با تأکید بر جرم‌شناسی اصلاح و درمان تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="line-height:2;"><span style="font-size:11pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><span lang="FA" style="font-size:12.0pt"><span style="font-family:Mitra">مجازات به‌عنوان یکی از ابزارهای اصلی سیاست جنایی، در طول تاریخ ایران از رویکردهای سنتی و تنبیهی به‌سمت رویکردهای اصلاحی و درمانی تغییر یافته است. این تحول نه‌تنها ناشی از تغییرات اجتماعی، فرهنگی و سیاسی بوده، بلکه تحت تأثیر نظریات جرم‌شناسی نوین و مطالعات تطبیقی بین‌المللی قرار گرفته است. مقاله حاضر با استفاده از رویکرد تحلیلی - توصیفی، روند تحول مفهوم مجازات در ایران را بررسی کرده و نقش جرم‌شناسی اصلاح و درمان در شکل‌گیری سیاست جنایی نوین را تحلیل می‌کند. محورهای اصلی تحقیق شامل بررسی تطور تاریخی مجازات، نقد سیستم‌های کیفری گذشته، تحلیل رویکردهای اصلاحی و درمانی و ارائه نمونه‌های عملی از تجربه‌های موفق و ناموفق در ایران است. یافته‌های پژوهش نشان می‌دهد که گرایش به مجازات اصلاحی و درمانی نه‌تنها بازدارندگی بیشتری ایجاد می‌کند، بلکه توانمندسازی فرد و کاهش بازگشت به جرم را نیز به‌دنبال دارد.</span></span></span></span></span></span></span></span></div> <div style="text-align: justify;">Penalties as one of the main tools of criminal policy, along the history of Iran, has changed traditional and punitive approaches to corrective and therapeutic approaches. This transformation is not only due to social, cultural and political changes, but influenced by the theories of modern criminology and international comparative studies. The present paper analyzes the transformation process of punishment in Iran using an analytical-descriptive approach and analyzes the role of correction and treatment in the formation of new criminal policy. The main axes of the research include examining the historical monuments of punishment, critique of past criminal systems, correctional and therapeutic approaches, and providing practical examples of successful and unsuccessful experiences in Iran. The findings of the research show that the tendency for corrective and therapeutic punishment does not only cause more deterrence, but also to empower the individual and reduce the return for crime.</div> مجازات, سیاست جنایی, اصلاح و درمان.
