fa تبیین فقهی و حقوقی چرایی تأثیر اعمال نماینده قراردادی بر تعهدات اصیل در عقد نکاح و پیامدهای آن تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="FA" style="font-size:12.0pt"><span style="line-height:115%"><span style="font-family:Mitra">عقد نکاح یکی از قراردادهای پراهمیت در گستره حقوق خصوصی به‌شمار می‌رود. در این نوع قرارداد، طرفین می‌توانند شخصی را به‌عنوان نماینده مشخص کنند تا برخی از امور مرتبط با عقد را انجام دهد. این بدان‌معنا است که فقه و حقوق، اصل تأثیرگذاری اعمال نماینده بر تعهدات اصیل را پذیرفته شده است. در این میان، پرسش از چرایی و پیامدهای تأثیر اعمال نماینده قراردادی بر تعهدات اصیل مطرح می‌گردد. به این معنا که نخست، باید چرایی تأثیرگذاری روشن گردد، سپس پیامدهای آن بررسی شود تا بتوان از گستره آن سخن به میان آورد. باتوجه به این‌که این مهم به‌صورت بایسته و شایسته از سوی اندیشه‌وران کاویده نشده است، پژوهش فرارو با روش توصیفی - تحلیلی و ابزار کتابخانه‌ای در پی پاسخ به پرسش مزبور است. یافته‌های پژوهش بیانگر آن است که با تمسک به ضوابط فقهی و مقررات قانونی می‌توان تأثیرگذاری تأثیر اعمال نماینده قراردادی را در گستره عقد نکاح توجیه نمود که این ضوابط فقهی عبارت از مصلحت و نبود عسر و حرج است. از دیگرسو، مقررات قانونی که مبتنی‌بر فقه است، نیز این مسأله را پذیرفته است. پیامدهای تأثیرگذاری اعمال نماینده قراردادی بر تعهدات اصیل آن است که درصورت رعایت چهارچوب و مکانیسم نمایندگی، تعهدات برخاسته از اعمال نماینده، متوجه اصیل خواهد شد و او باید، تعهدات را پذیرا باشد.</span></span></span></span></span></span></span></span></span><br> &nbsp; <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:461px; padding:0in 7px 0in 7px; height:124px"><span style="font-size:11pt"><span style="line-height:normal"><span style="font-family:Calibri,sans-serif"><span new="" roman="" style="font-family:" times="">Marriage contract (&lsquo;aqd al-Nikah) is considered one of the most significant agreements within the domain of private law. In this type of contract, the parties may appoint an agent (wakil) to carry out certain matters related to the marriage contract on their behalf. This implies that both Islamic jurisprudence (fiqh) and civil law recognize the principle that acts performed by a contractual agent legally bind the principal. In this context, the question arises as to why and how the acts of a contractual agent affect the obligations of the principal. Accordingly, it is first necessary to clarify the rationale behind this legal effect and then examine its consequences in order to delineate its scope. Given that this issue has not been sufficiently and appropriately addressed by scholars, the present study - employing a descriptive-analytical methodology and relying on library-based research - aims to answer this question. The findings indicate that, by recourse to established jurisprudential principles and statutory regulations, the binding effect of a contractual agent&rsquo;s acts within the framework of a marriage contract can be justified. These jurisprudential principles include considerations of public interest (maslaha) and the avoidance of hardship and undue difficulty (&lsquo;usr wa haraj). Furthermore, statutory provisions - themselves grounded in Islamic jurisprudence - also endorse this principle.
