fa تحلیل مبانی فقهی و حقوقی حمایت کیفری از معادن Analysis of the Jurisprudential and Legal Foundations of Criminal Protection of Mines تخصصي Special پژوهشي Research <div style="text-align: justify;">معادن به‌عنوان یک سرمایه ملی، متعلق به یک نسل نیست تا بتوان به‌صورت بی‌رویه و بی‌ضابطه با آن مواجهه نمود، بلکه مال همه ملت و حتی نسل‌های آینده نیز است. ازاین‌رو باید از آن به‌گونه‌ای بهره‌برداری شود که حقوق دیگران تضییع نگردد. گاهی مشاهده می‌شود که برخی به‌صورت غیراصولی یا بی‌ضابطه اقدام به استخراج معادن می‌نمایند. این عمل از یک‌سو می‌تواند دستبرد به حقوق دیگران به‌شمار رود و از دیگرسو، تغییر اکوسیستم را به‌دنبال داشته باشد که برآیند آن، تهدید سلامت جامعه و محیط است. در این میان، پرسش امکان‌سنجی حمایت از معادن مطرح می‌شود، به این معنا که باید امکان حمایت از معادن در برابر تعدی‌های ناروا بررسی گردد تا تعدی‌کنندگان با سزاهای حقوقی و قانونی مواجه شوند. پژوهش فرارو با روش توصیفی - تحلیلی و ابزار کتابخانه‌ای در پی پاسخ به این پرسش است. یافته‌های پژوهش بیانگر آن است که با تمسک به اصول حقوقی و ضوابط فقهی، مانند لاضرر، حرمت اکل مال به باطل، اصل حاکمیت دولت بر معادن و اصل لزوم توسعه پایدار می‌توان حمایت کیفری از معادن را اثبات نموده، تعدی‌کنندگان را مسؤول انگاشت.</div> <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:461px; padding:0in 7px 0in 7px; height:124px">Mines, as a national asset, do not belong to one generation so that they can be dealt with indiscriminately and without regulation; rather, they belong to the entire nation and even future generations; therefore, they must be exploited in a way that does not violate the rights of others. Sometimes it is observed that some people attempt to extract minerals in an unprincipled or unregulated manner. On the one hand, this act can be considered an infringement on the rights of others and, on the other hand, it can lead to changes in the ecosystem, which in turn threatens the health of society and the environment. In the meantime, the question of the feasibility of protecting mines is raised; meaning that the possibility of protecting mines against unjustified encroachments should be examined so that the encroachments face legal and legal punishments. The present research seeks to answer this question using a descriptive-analytical method and library tools. The findings of the research indicate that by adhering to legal principles and jurisprudential criteria such as non-harm, the prohibition of the acquisition of property by falsehood, the principle of state sovereignty over mines, and the principle of the necessity of sustainable development, criminal protection of mines can be proven and the encroachments held accountable.</td> </tr> </tbody> </table> حمایت کیفری, معدن, قاعده فقهی, حاکمیت بر معادن.
