fa آثار الحاق ایران به موافقت‌نامه مادرید راجع به ثبت بین‌المللی علائم تخصصي Special پژوهشي Research <div style="text-align: justify;"> <h1 dir="RTL"><span style="font-size:14px;"><strong><span style="font-family:Mitra;">زمینه و هدف:</span></strong> <span style="font-family:Mitra;">اسناد بین‌المللی همواره به‌عنوان یکی از منابع الهام و ابزاری جهت اصلاح قوانین تلقی می‌شود، به‌طوری که الحاق و پذیرش آن‌ها می‌تواند تأثیرات متعددی بر حقوق داخلی بگذارد. لذا در این مقاله به دنبال تبیین آثار الحاق ایران به موافقت‌نامه مادرید در رابطه با ثبت علایم تجاری هستیم</span><span style="font-family:Mitra;">.</span><br> <strong><span style="font-family:Mitra;">مواد و روش‌ها:</span></strong> <span style="font-family:Mitra;">نوع تحقیق حاضر، نظری و روش تحقیق آن توصیفی تحلیلی می‌باشد</span><span style="font-family:Mitra;">.</span><br> <strong><span style="font-family:Mitra;">ملاحظات اخلاقی:</span></strong> <span style="font-family:Mitra;">در این تحقیق با اصالت متون، صداقت و امانت‌داری رعایت شده است.</span> <strong><span style="font-family:Mitra;"></span></strong><br> <strong><span style="font-family:Mitra;">یافته‌ها:</span></strong> <span style="font-family:Mitra;">امروزه مباحث مربوط به مالکیت به‌خصوص در زمینه‌های معنوی و موضوعات مرتبط با حمایت از این حقوق از اهمیت ویژه‌ای برخوردار است، به‌طوری که با شکل گیری حقوق مالکیت معنوی حمایت از بخش جدیدی از مالکیت در اجزایی همچون مالکیت صنعتی، اختراعات، علائم تجاری، طرح‌های صنعتی و آثار ادبی و هنری در سطوح ملی و بین‌المللی صورت پذیرفت. در این راستا، در زمینه‌ی بین‌المللی ایران با پیوستن به موافقت‌نامه (1891) و پروتکل (1989) مادرید، گام بلندی در راستای حمایت از این نوع مالکیت برداشت. بنابراین، ایران به شکل رسمی با قبول قوانین مدون موافقت‌نامه مادرید، حمایت از علامت‌های تجاری در سطح جهانی</span> <span style="font-family:Mitra;">را پذیرفت و از آن تبعیت نمود</span><span style="font-family:Mitra;">.</span><span style="color:black;"><span style="font-family:Mitra;"></span></span><br> <strong><span style="font-family:Mitra;">نتیجه‌گیری:</span></strong> <span style="font-family:Mitra;">عضویت ایران در معاهده مادرید در </span><span style="font-family:Mitra;">نحوه حمایت، در سیستم طبقه‌بندی، در منع نصب نشانه‌های غیر واقعی و حل مشکل مدرنیزه شدن فناوری اطلاعاتی علائم تجاری تأثیرات شکلی و ماهیتی داشته است</span><span style="font-family:Mitra;">.</span></span></h1> </div> <div style="text-align: justify;"><strong>Background and Aim</strong>: International instruments have always been considered as a source of inspiration and a tool for amending laws, so that their accession and acceptance can have several effects on domestic law. Therefore, in this article, we seek to explain the effects of Iran&#39;s accession to the Madrid Agreement in relation to the registration of trademarks.<br> <strong>Materials and Methods</strong>: The type of research is theoretical and its research method is descriptive-analytical.<br> <strong>Ethical Considerations</strong> In this research, with the originality of the texts, honesty and trustworthiness have been observed.<br> <strong>Findings:</strong> Nowadays, issues related to property, especially in the intellectual field and issues related to the protection of these rights are of special importance, so that with the formation of intellectual property rights, support for a new part of property in components such as industrial property, inventions, Trademarks, industrial designs and literary and artistic works were made at national and international levels. In this regard, in the international arena of Iran, by joining the Madrid Agreement (1891) and the Protocol (1989), Madrid took a big step towards supporting this type of ownership. Thus, Iran formally accepted and complied with global trademark protection by accepting the rules of the Madrid Agreement.<br> <strong>Conclusion:</strong> Iran&#39;s membership in the Madrid Agreement has had formal and substantive effects on the manner of protection, the classification system, the prohibition of installing unrealistic signs and solving the problem of modernization of trademark information technology.</div> موافقت‌نامه مادرید, علایم تجاری, مالکیت معنوی, ایران.
