fa الأساس الشرعی و القانونی لجریمه التحرش الجنسی فی الشریعه The Sharia and Legal Foundations of the Criminalization of Sexual Harassment under Islamic Sharia and Iraqi Law تخصصي Special پژوهشي Research <div style="text-align: justify;">تعد جریمه التحرش الجنسی من الجرائم التی حظیت باهتمام فقهی وتشریعی متزاید فی السنوات الأخیره، لما تمثله من اعتداء علی کرامه الإنسان وحرمه جسده، وما تترکه من آثار نفسیه واجتماعیه وأخلاقیه تمس الفرد والمجتمع. وقد أدی تنوع صور هذه الجریمه واتساع نطاقها إلی ضروره إعاده النظر فی الأسس التی تقوم علیها حمایتها القانونیه والشرعیه، ولا سیما فی العراق الذی نص دستوره علی أن الإسلام دین الدوله الرسمی ومصدر أساسی للتشریع، الأمر الذی یقتضی الوقوف علی موقف الشریعه الإسلامیه والتشریع العراقی من هذه الجریمه، وبیان مدی کفایه التنظیم القانونی لمواجهتها. وانطلاقًا من ذلک،یبین البحث التعریف بجریمه التحرش الجنسی مع التطرق لأهم آثارها، ثم اسنادها لأساسها التشریعی فی القرآن الکریم والسنه النبویه الشریفه وروایات أهل البیت (علیهم السلام)، ثم الکشف عما إذا کانت الشریعه قد تناولت هذه الجریمه بذاتها أم استلمتها من خلال النصوص والقواعد العامه التی تحرمها، کما تناول البحث موقف المشرع العراقی، وبیان ما إذا کان قد نظم جریمه التحرش الجنسی بتنظیم تشریعی مستقل أم عالجها ضمن نصوص متفرقه فی قانون العقوبات وقانون العمل کون ساحات العمل کانت و ما تزال عرضه لهکذا نوع من الجرائم خاصه فی حق المرأه. واعتمد الباحث المنهج الوصفی التحلیلی المقارن خلال بحثه وهدف هذا البحث الی تقدیم رؤیه مقارنه بین الاحکام الفقهیه والنصوص القانونیه، للوقوف علی مواطن الاتفاق والاختلاف، والخروج بتوصیات تسهم فی تطویر التشریع الوطنی. حیث وجد الباحث أن الشریعه الإسلامیه أرست أساسًا تشریعیًا متکاملًا لتجریم جمیع صور التحرش الجنسی من خلال النصوص الشرعیه والقواعد العامه الرامیه إلی صیانه العرض والکرامه الإنسانیه؟فی حین لم یفرد المشرع العراقی قانونًا مستقلًا لهذه الجریمه، وإنما نظم بعض صورها فی نصوص متفرقه، الأمر الذی یستدعی تطویر المنظومه التشریعیه بإصدار تنظیم قانونی متکامل یواکب تطور صور هذه الجریمه ویحقق حمایه جنائیه أکثر فاعلیه.</div> <table class="MsoTableGrid" style="border-collapse:collapse; border:none"> <tbody> <tr> <td style="width:501px; padding:0cm 7px 0cm 7px; height:124px">Sexual harassment has become one of the crimes that has attracted increasing scholarly and legislative attention in recent years due to its serious violation of human dignity and bodily integrity, as well as its profound psychological, social, and moral consequences for both individuals and society. The growing diversity and prevalence of this crime have highlighted the need to examine the legal and Islamic foundations governing its regulation, particularly in Iraq, where Islam is the official religion of the State and a fundamental source of legislation. Accordingly, this study examines the position of both Islamic Sharia and Iraqi legislation toward sexual harassment and evaluates the adequacy of the existing legal framework in addressing this offense. The study begins by defining sexual harassment and explaining its societal impact, then analyzes its legislative basis in the Holy Qur'an, the Prophetic Sunnah, and the narrations of the Ahl al-Bayt (peace be upon them), in order to determine whether Islamic Sharia addressed this crime explicitly or through general legal principles prohibiting such conduct. It further examines the position of the Iraqi legislator by investigating whether sexual harassment has been regulated through an independent legislative framework or through scattered provisions within the Iraqi Penal Code and the Iraqi Labour Law. The research adopts a descriptive, analytical, and comparative approach. The study concludes that Islamic Sharia has established a comprehensive legislative framework that criminalizes all forms of sexual harassment through legal principles aimed at safeguarding human dignity and honor. In contrast, Iraqi legislation has addressed only certain forms of the offense through dispersed legal provisions without enacting a comprehensive and independent law, thereby necessitating legislative reform through the adoption of a unified legal framework capable of addressing the evolving nature of this crime and providing more effective criminal protection.</td> </tr> </tbody> </table> الشریعه الإسلامیه, القرآن الکریم, السنه النبویه, أهل البیت (علیهم السلام), القانون العراقی, قانون العقوبات, قانون العمل.
