fa مقابله با دزدی دریایی در پرتو کنوانسیون مقابله با جرایم سازمان‌یافته فراملی (پالرمو 2000) Combating Piracy in the Light of the Convention against Transnational Organized Crime (Palermo 2000) تخصصي Special پژوهشي Research زمینه و هدف: مهم‌ترین کنوانسیون موجود در زمینه دزدی دریایی کنوانسیون حقوق دریاها 1982 است. اما این کنوانسیون با توجه به سال تدوین آن از محدودیت‌های فراوانی در برقراری یک چارچوب حقوقی مناسب برای مقابله با «دزدی دریایی نوین» که تفاوت‌های آشکاری با اسلاف خود دارد مواجه است. حال باید دید آیا کنوانسیون مقابله با جرایم سازمان یافته فراملی 2000 می تواند چارچوب حقوقی مناسبی برای مقابله با دزدی دریایی نوین ایجاد نماید؟ مواد و روش‌ها: روش تحقیق در این پژوهش توصیفی- تحلیلی است. ملاحظات اخلاقی: در این تحقیق، اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: دزدی دریایی که طی سالیان اخیر در آبراه‌های بین‌المللی در حال وقوع است هم ازنظر نحوه و شیوه وقوع و هم ازنظر اهداف و حتی مناطقی که حملات در آنجا اتفاق می‌افتند با گذشته تفاوت داشته و از این نظر مقررات و تعریف موجود در کنوانسیون حقوق دریاها قابلیت انطباق با آن را ندارد. ازاین‌رو همان‌گونه که شورای امنیت سازمان ملل نیز در برخی قطعنامه‌های خود اصرار دارد ضروری است از مقررات دیگر اسناد بین‌المللی برای پوشانیدن خلأها بهره گرفته شود. نتیجه‌گیری: کنوانسیون مقابله با جرایم سازمان‌یافته فراملی 2000 یکی از مهم‌ترین اسناد بین‌المللی برای این منظور است. اما برای بهره‌گیری از مفاد این سند ابتدائا بایستی دید که آیا اساساً جرم دزدی دریایی را می‌توان یک «جرم سازمان‌یافته فراملی» مطابق تعریف کنوانسیون تلقی کرد یا خیر، و در صورت مثبت بودن پاسخ به این پرسش بایستی بررسی کرد که از این سند بین‌المللی چه بهره یا بهره‌هایی برای مقابله هرچه مؤثرتر با دزدی دریایی نوین می‌توان دریافت داشت. Background and Aim: The most important convention on piracy is the 1982 Convention on the Law of the Sea. However, due to the year of its drafting, this convention faces many limitations in establishing an appropriate legal framework to deal with the "new piracy", which is clearly different from its predecessors. It remains to be seen whether the Convention against Transnational Organized Crime 2000 can provide an appropriate legal framework for combating modern piracy. Materials and Methods: The research method in this research is descriptive-analytical. Ethical Considerations: In this research, the originality of the texts, honesty and trustworthiness have been observed. Findings: The piracy that has been taking place on international waterways in recent years is different from the past, both in terms of how it occurs and in terms of the targets and even the areas where the attacks took place. Do not have it. Therefore, as the UN Security Council has insisted in some of its resolutions, it is essential that the provisions of other international instruments be used to fill the gaps. Conclusion: The 2000 Convention against Transnational Organized Crime is one of the most important international instruments for this purpose. But to take advantage of the provisions of this document, it must first be seen whether, in essence, the crime of piracy can be considered a "transnational organized crime" as defined by the Convention.
