fa گونه‌شناسی خطاهای قضات در حقوق ایران Typology of Judges' Mistakes in Iranian Law تخصصي Special پژوهشي Research زمینه و هدف: مسؤولیت مدنی دولت و کارکنان آن اندیشه نسبتاً جدیدی است که مباحث گوناگونی را پدید آورده است. نظر به اهمیت جایگاه قضاوت و تأثیر آن در تأمین منافع افراد، خطای قاضی می‌تواند از مهم‌ترین مصادیق خطای کارکنان دولت محسوب شود. مواد و روش‌ها: روش تحقیق در این مقاله به‌صورت توصیفی بوده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: اشتباه قاضی به اعتبارات گوناگون قابل تقسیم‌بندی است و منشأ آن نیز می‌تواند جهل قاضی یا تفسیر نادرست وی از متون قانونی باشد. نتیجه‌گیری: در هر مورد که شخص ناگزیر از جبران خسارت دیگری باشد در برابر او مسؤولیت مدنی دارد. بنابراین می‌توان این تعابیر را به عملکرد قاضی و آثاری که به دنبال قضاوت او مترتب می‌شود نیز نسبت داد و خسارت‌هایی که به موجب حکم او به اشخاص وارد می‌شود، از همین قبیل است. ولی هرگاه خسارت وارده مستند به عمل آنان نبوده، مربوط به نقض وسایل ادارات و مؤسسات مزبور باشد، در این صورت جبران خسارت برعهده اداره یا مؤسسه مربوط است Background and Aim: The civil liability of the government and its employees is a relatively new idea that has created a variety of topics. Materials and Methods: It is descriptive study. Ethical Considerations: All ethical considerations have been observed. Findings: The judge's mistake can be divided for a variety of reasons, and its origin can also be the judge's ignorance or his misinterpretation of legal texts. Conclusion: In any case where a person is forced to compensate for other compensation, he or she has civil liability. Therefore, these interpretations can also be attributed to the judge's performance and the works that follow his judgment. The damages caused to individuals by the judge's ruling are an example of the judge's mistake.
