fa مستی و درجات آن از منظر پزشکی قانونی، حقوق کیفری ایران و فقه امامیه Drunkenness and its Degrees from the Perspective of Forensic Medicine, Iranian Criminal Law and Imami Jurisprudence تخصصي Special پژوهشي Research زمینه و هدف: سُکر به معنی مستی و حالتی است که میان انسان و عقل او قرار می‌گیرد یا عارض می‌شود. بعضی از اندیشمندان اسلامی، مُسکر را چیزی می‌دانند که موجب اِخلال در نظم کلام و افشاء راز می‌گردد و به عبارتی، چیزی است که موجب اختلال در ادراک و عقل می‌شود و در بیشتر کسانی که شرب خمر می‌کنند، با حسِ شادی و تواناییِ کاذب همراه است. مواد و روش‌ها: روش تحقیق در این مقاله به‌صورت توصیفی بوده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: مصرف مسکر از جرایم حدی و از نوع حق‌اللهی است که اثبات آن، مشمول قواعد سخت‌گیرانه‌ای است. مصرف خمر و سایر مسکرات، آثار و تبعات ناخوشایند و نامطلوبی ازلحاظ روحی و روانی دارد. امروزه ثابت شده است که اسلام در برخورد با مسأله مسکرات، راه راست و درستی را برگزیده است. علمِ کنونی نیز ثابت کرده است که مواد الکلی به‌راستی، ام الخبائث و ریشه همه تبهکاری‌ها و مفسده‌هایی است که مایه از میان رفتن عقل، فکر، سلامت و ثروت و گسیختگی نظام خانواده می‌شود. نتیجه‌گیری: قانون مجازات اسلامی در مواد مختلفی درباره مستی بحث کرده است. بنابراین قانون‌گذار، مستی را جرم‌انگاری نکرده، بلکه مصرف مسکر را جرم‌انگاری نموده است، به‌طوری‌که حتی اگر فردی ماده مسکر را بخورد، ولی مست نشود، حتی اگر یک قطره هم باشد، باز به مجازات حد اسلامی محکوم می‌شود. بنابراین آنچه برای شارع مقدس اسلامی مهم بوده است، مصرف ماده سکرآور است، نه حالت بعدازآن.   Background and Aim: Drunkenness means drunkenness and a state that is placed between a person and his intellect or is affected. Some Islamic thinkers consider Muskar as something that disturbs the order of words and reveals secrets, in other words, it is something that disturbs perception and intellect, and in most people who drink alcohol, with a sense of joy. Materials and Methods: It is descriptive study. Ethical Considerations: All ethical considerations have been observed. Findings: Taking intoxicants is a Hadd crime and has unpleasant psychological effects and consequences. Today, it has been proven that Islam has chosen the right path in dealing with the issue of intoxicants. Current science has also proved that alcohol is, indeed, the root of all crimes and corruptions that cause the loss of intellect, thought, health and wealth, and the rupture of the family system. Conclusion: The Islamic Penal Code discusses drunkenness in various articles. Therefore, the legislator has not criminalized drunkenness, but has criminalized the consumption of intoxicants, so that even if a person eats intoxicants but does not get drunk, even if it is a drop, he will be sentenced to the Islamic punishment named Hadd.
