fa مبانی تحدید و سلب مالکیت از اشخاص از سوی دولت The Basics of Restricting the Ownership of Persons by the Government تخصصي Special پژوهشي Research زمینه و هدف: مسأله تحدید و سلب مالکیت از اشخاص از سوی دولت یکی از مسائل مهم جامعه است. پرسش اصلی تحقیق این است که دولت با چه مجوزی می‌تواند اقدام به سلب و تحدید مالکیت از اشخاص نماید و در حقیقت مبنای فقهی و حقوقی قلمرو حاکمیت دولت در تحدید و سلب مالکیت از اشخاص چیست؟ مواد و روش‌ها: روش تحقیق در این مقاله به‌صورت توصیفی بوده است. ملاحظات اخلاقی: تمامی اصول اخلاقی در نگارش این مقاله رعایت شده است. یافته‌ها: در مجموع می‌توان نظریه‌‌های سلب مالکیت را به سه دسته تقسیم نمود: آزادی مطلق مالکیت (سرمایه‌داری)؛ سلب مالکیت مطلق شخصی (اشتراکی یا سوسیالیزم) و سلب مالکیت جزئی شخصی (نظر اسلام). نتیجه‌گیری: توجیهاتی مانند تقدم منافع عمومی بر خصوصی، مصلحت، اعمال حاکمیت توسط دولت و استناد به قاعده فقهی لاضرار، می‌تواند مجوز تحدید مالکیت خصوصی اشخاص باشد.   Background and Aim: The issue of limiting the ownership of persons by the state is one of the most important issues in society. The main question of the research is, with what permission can the government restrict the ownership of individuals, and in fact, what is the jurisprudential and legal basis of the realm of state sovereignty in restricting the ownership of individuals? Materials and Methods: It is descriptive study. Ethical Considerations: All ethical considerations have been observed. Findings: In sum, theories of restricting ownership can be divided into three categories: Absolute Freedom of ownership (Capitalism), Complete Limiting of personal property (Shared or Socialism) and Partial Limiting of personal property (Islamic opinion). Conclusion: Justifications such as the primacy of public interest over private, expediency, the exercise of sovereignty by the state, and the jurisprudential rule of La-Zarar, can be a license to restrict the private property of individuals.   تحدید مالکیت, فقه, دولت.
