fa فرایند دادرسی کیفری به مفاسد اقتصادی در منابع ملی از دیدگاه حقوق کیفری شکلی ایران تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra">زمینه و هدف: </span></b><span lang="AR-SA" style="font-family:Mitra"><span style="color:black">امروزه ضرورت کنترل مفاسد اقتصادی در منابع ملّی و اتخاذ یک سیاست جنایی کارآمد در جامعه کاملاً محسوس است.</span></span> <span lang="AR-SA" style="font-family:Mitra"><span style="color:black">طبق آمارهای موجود جرائم منابع ملّی از لحاظ کمی و کیفی در سطح کشور در حال افزایش می‌باشد به‌طور روزمره شاهد شنیدن اخباری در خصوص تصرّف اراضی کشاورزی، منابع طبیعی، معادن، و سایر منابع ملّی هستیم.</span></span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra"><span style="color:black">مواد و روش‌ها:</span></span></b><span lang="AR-SA" style="font-family:Mitra"><span style="color:black"> روش تحقیق در این پژوهش توصیفی ـ تحلیلی و کتابخانه‌ای است.</span></span></span></span></span></span></span><br> <span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="AR-SA" style="font-family:Mitra">ملاحظات اخلاقی:</span></b> <span lang="AR-SA" style="font-family:Mitra"><span style="color:black">کلیه اصول اخلاقی حاکم در پژوهش، در تقریر این مقاله رعایت شده است.</span></span><span lang="AR-SA" style="font-family:Mitra"></span></span></span></span><br> <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="font-family:Mitra">یافته‌ها: </span></b><span lang="AR-SA" style="font-family:Mitra"><span style="color:black">نتایج حاصل از مطالعات پژوهشی حاکی از این است که در قلمرو حقوق کیفری ایران مرتبط با جرائم منابع ملّی ضمن اینکه جرم انگاری مناسب صورت نگرفته و شاهد معایب و نواقص خاصی هستیم، مجازات‌های تعیین شده از لحاظ نوع و شدّت جنبه بازدارندگی کیفری مناسبت ندارند. ازاین‌رو، با توجه به اهمیت حفاظت و صیانت از منابع طبیعی و ملّی، تدوین سیستم دادرسی افتراقی احساس می‌شود و ضرورت دارد مشمول حمایت‌های حقوقی و تأسیس دادرسی ویژه‌ای گردد. علاوه بر آن با توجه به اهمیت ویژه این جرائم و آثار مخرب آن بر محیط و جامعه و حتی بُعد بین‌المللی آن تدابیر ویژه‌ای نیز در خصوص بازداشت موقت و وقت احتیاطی و سایر قرارها باید مورد توجه قرار بگیرد و پیشنهاد می‌شود دفاتری تأسیس و به‌کارگیری شود که ارتباطی مستمر و نزدیک با کشورهای همسایه در جهت همکاری و صیانت از منابع طبیعی و ملّی صورت بگیرد.</span></span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="background:#f2f2f2"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="FA" style="font-family:Mitra"><span style="color:black">نتیجه‌گیری</span></span></b><b><span lang="AR-SA" style="font-family:Mitra">:</span></b> <span lang="AR-SA" style="font-family:Mitra"><span style="color:black">در نظام کنونی نیازمند آیین دادرسی افتراقی در مرجله دادرسی و اجرا هستیم که باعث سرعت در روند دادرسی و تحقیق و تعقیب می‌شود و ایجاد شعب اختصاصی در این عرصه احساس می‌شود.</span></span></span></span></span></span></span><br> &nbsp; <h2 style="margin-right:-26px; text-align:justify"><span style="font-size:7pt"><span style="line-height:normal"><span style="page-break-after:auto"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span style="font-size:11.0pt"><span style="color:#002060">Background and Aim</span></span><span style="font-size:11.0pt">:</span> <span style="font-size:11.0pt"><span style="font-weight:normal">Today, the necessity of controlling economic corruption in national resources and adopting an efficient criminal policy in the society is quite noticeable. According to the available statistics, national resource crimes are increasing quantitatively and qualitatively in the country. Therefore, due to the importance of protection and preservation of natural and national resources, the development of a differential judicial system is felt and it is necessary to include legal protections and the establishment of special proceedings.
