fa مفهوم‌شناسی و تاریخچه آثار ملی در حقوق ایران پژوهشي Research <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> اصطلاح اثر ملی عنوانی آشنا برای شهروندان امروز است. با این حال، این اصطلاح چندان قدیمی نیست و قدمت وضع آن توسط قانونگذار ایرانی به بیش از نه دهه نمی&shy;رسد. نخستین&shy;بار این اصطلاح در آثار و تألیفات روشنفکران دوره قاجاریه عنوان شد و بحث از حفظ و حراست از ابنیه و وسایل تاریخی مطرح شد؛ پس از روی کار آمدن حکومت پهلوی در سال 1309 با تصویب قانونی خاص به نظام حقوقی کشور وارد شد.<span style="font-family:Mitra;"></span><br> <strong>مواد و روش‌ها:</strong> روش تحقیق در این نوشتار، توصیفی-تحلیلی است.<span style="font-family:Mitra;"></span><br> <strong>ملاحظات اخلاقی:</strong> ملاحظات اخلاقی مربوط به نگارش متون و نیز ارجاع‌دهی به منابع رعایت گردید.<br> <strong>یافته‌ها:</strong> در قوانین و مقررات مربوط به آثار ملی، نمی&shy;توان تعریف جامع و مانعی را در این خصوص ملاحظه کرد. همچنین این مفهوم با مفاهیم مشابه‌ای مانند اموال فرهنگی، اموال تاریخی، اموال هنری، اشیاء عتیقه، نفایس ملی، دفینه و آثار ملی طبیعی هم‌پوشانی دارد.<span style="font-size:12.0pt;"></span><br> <strong>نتیجه‌گیری:</strong> مطابق با نظم حقوقی کنونی در زمینه آثار ملی برای وصف اثر فرهنگی ـ تاریخی، می&shy;بایست یک&shy;صد سال از تاریخ ساخت یا از عمر آن اثر سپری شده باشد تا در زمره آثار ملی&nbsp; قرار گیرد.<strong><span style="font-family:Mitra;"></span></strong></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><strong>Background and Aim:</strong> The term &ldquo;National Monuments&rdquo; is a familiar title for today&rsquo;s citizens. However, this term is not as old as nine decades. The first time, this term has been mentioned in the books of intellectual authors in the Qajar era. After the establishment of Pahlavi, special legal rules have been passed in 1930.<br> <strong>Materials and Methods:</strong> For present study, the analytical-descriptive approach has been chosen.<br> <strong>Ethical Considerations:</strong> All ethical considerations as well as authenticity of the texts have been observed.<br> <strong>Findings:</strong> In laws and regulations related to national monuments, we cannot consider a comprehensive definition in this regard.
