fa جنبه های حقوقی مقابله با رقابت مکارانه در تجارت الکترونیک پژوهشي Research <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> تجربه اغلب کشورها و بررسی کنوانسیون&shy;های بین&shy;المللی نشان می&shy;دهد که نسبت به گذشته یک حرکت فعال برای مقابله با رقابت مکارانه به وجود آمده است اما، تجارت الکترونیکی به عنوان یک پدیده نوظهور اقتضائات خاص خود را می&shy;طلبد.<br> <strong>مواد و روش‌ها:</strong> در این مقاله، با یک رویکرد تحلیلی و توصیفی قوانین جاری در نظام&shy;های حقوقی و نحوه&shy; اعمال آن در مراجع قانونی در ارتباط با این موضوع مورد بررسی قرار گرفته است.<span style="font-family:Mitra;"></span><br> <strong>ملاحظات اخلاقی:</strong> ملاحظات اخلاقی مربوط به نگارش متون و نیز ارجاع‌دهی به منابع رعایت گردید.<br> <strong>یافته‌ها:</strong> جنبه&shy;های بروز رقابت مکارانه در تجارت الکترونیک، بررسی مواد قانونی لازم‌الاجرا در حقوق ایران و مقایسه&shy; تطبیقی با سایر کشورها و نحوه&shy; اعمال ضمانت اجراهای حقوقی برای حمایت از رقابت مشروع در تجارت الکترونیک مورد کنکاش این مقاله است.<span style="font-size:12.0pt;"></span><br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong> <span dir="RTL">علی&shy; رغم وجود قوانین نسبتاً مناسب در ایران، به واسطه&shy; عدم وجود ساختارها و زمینه‌سازی مناسب برای اجرایی کردن این قوانین، امکان مقابله&shy; مؤثر با رقابت مکارانه تاکنون میسر نشده است.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> This Article deals with the legal solutions to address dumping in electronic trade. The experiences of different countries as well as the review of the international conventions show that a new move has been emerged to counter dumping. However, electronic trade as a recent phenomenon has a particular nature.<span dir="RTL"></span><br> <strong>Materials and Methods:</strong> The research method in this paper is descriptive-analytical<strong><span dir="RTL">.</span></strong><br> <strong>Ethical Considerations:</strong> Ethical considerations regarding the writing of texts as well as references to sources were observed<span dir="RTL">.</span><br> <strong>Findings:</strong> This Article examines and analyzes the legal framework in the field of dumping in the context of electronic trade. In order to present a comprehensive study, this Article also considers comparative aspects of the subject.
