fa تعهدات خاص اعضای سازمان تجارت جهانی تحت موافقت‌نامه عمومی تجارت خدمات (GATS) و تعارضات آن با قوانین ایران پژوهشي Research <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> موافقت‌نامه عمومی تجارت خدمات (گاتس) به‌عنوان یکی از سه موافقت‌نامه اصلی منضم به موافقت‌نامه سازمان تجارت جهانی حاوی دو دسته تعهدات عام و خاص می&shy;باشد. تعهدات عام، تعهداتی است که اعضا به‌صرف عضویت و الحاق به سازمان ملزم به آن هستند. تعهدات خاص شامل دسترسی به بازار، رفتار ملی و تعهدات اضافی است که از طریق جداول ملی متناسب با شرایط و سطح تعهدات هر عضو تعیین می&shy;شود و مورد مذاکره قرار می&shy;گیرد.<br> <strong>مواد و روش‌ها:</strong> روش تحقیق در این نوشتار، توصیفی-تحلیلی است.<span style="font-family:Mitra;"></span><br> <strong>ملاحظات اخلاقی:</strong> ملاحظات اخلاقی مربوط به نگارش متون و نیز ارجاع‌دهی به منابع رعایت گردید.<br> <strong>یافته‌ها:</strong> اعضا سازمان تجارت جهانی ملزم به هماهنگ‌سازی قوانین داخلی خود با الزامات سازمان تجارت جهانی هستند. در قوانین ایران مواردی از تعارض با الزامات تعهدات خاص گاتس وجود دارد که ضروری است در جهت هماهنگی با قواعد سازمان این تعارضات برطرف گردند.<span style="font-size:12.0pt;"></span><br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong> <span dir="RTL">اصول 81 و 82 قانون اساسی، مقررات سرمایه‌گذاری و مناقصات در قوانین ایران با تعهدات خاص سازمان تجارت جهانی در تعارض است</span><span dir="RTL">.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The General Agreement on Trade in Services, as one of the three main agreements attached to the WTO Agreement, contains two categories of general and specific obligations. General obligations are obligations that members are required to comply with when joining the organization. Specific commitments include market access, national behavior, and additional commitments, which are determined and negotiated through national tables appropriate to the terms and level of each member&#39;s commitments.<br> <strong>Materials and Methods:</strong> The research method in this paper is descriptive-analytical<strong><span dir="RTL">.</span></strong><br> <strong>Ethical Considerations:</strong> Ethical considerations regarding the writing of texts as well as references to sources were observed<span dir="RTL">.</span><br> <strong>Findings:</strong> WTO members are required to align their domestic laws with WTO requirements.
