fa تحلیلی بر حقوق اقتصادی در نظم کنونی حقوقی پژوهشي Research <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> حقوق اقتصادی را باید حقوق سازماندهی و توسعه دانست که در کنار سایر ویژگی&shy; های خود از جمله کارآیی بازار، انعطاف&shy; پذیری، مشارکت دولت و بخش خصوصی و با ایجاد نهادهای جدید، موجب افزایش ثروت و کارآیی بازار و توسعه همه&shy; جانبه عدالت اقتصادی در جامعه خواهد شد. در حقوق اقتصادی، مفاهیم بکار گرفته&shy; شده، در شکل&shy; گیری نهادهای خصوصی و در تدوین و تفسیر قوانین و مقررات، نقش اساسی دارد،که مقررات از زمره آن مفاهیم است. حقوق اقتصادی، شاخه&shy; ای نو در علم حقوق و به موازات، علم اقتصاد است و به نوعی، حقوقی کردن اقتصاد با پارامتر دخالت دولت تلقی می&shy; گردد. این شاخه حقوقی با روزآمدی قوانین و مقررات و ایضاً با ایجاد نهضت مقررات&shy; زدایی، پنجره&shy; ای نو در بسط و توسعه عدالت اجتماعی می&shy; گشاید.<span style="font-family:Mitra;"></span><br> <strong>مواد و روش‌ها:</strong> روش تحقیق در این پژوهش به صورت &nbsp;توصیفی ـ تحلیلی است.<br> <strong>ملاحظات اخلاقی:</strong> در این تحقیق، اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<br> <strong>یافته‌ها:</strong> این پژوهش در پی آن است که با تبیین جایگاه کاربردی حقوق اقتصادی، ضرورت استفاده از یافته&shy; های علم اقتصاد در تحلیل قواعد حقوقی را بیان و ضرورت حذف قوانین ناکارآمد و نظارت صحیح بر اجرای اصل خصوصی &shy;سازی، که از اهداف عالیه حقوق اقتصادی و از پیش&shy; درآمدهای ورود ایران به عرصه تجارت جهانی است را به اثبات رساند. <span dir="LTR"></span><br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong> <span dir="RTL">با توجه به سرعت پیشرفت تکنولوژی در عصر حاضر، ضرورت هم&shy;سو بودن با علم روز و شاخه نوظهور حقوق اقتصادی، در راستای روزآمد بودن حقوق و اقتصاد، دوچندان است.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim</strong>: Economic law should be considered as the law of organization and development, which along with its other characteristics such as market efficiency, flexibility, government-private sector participation and by creating new institutions, increases wealth and market efficiency and comprehensive development of economic justice. In the society will be. In economic law, the concepts used play a key role in the formation of private institutions and in the formulation and interpretation of laws and regulations, of which regulations are among the concepts. Economic law is a new branch in the science of law and, in parallel, the science of economics, and in a way, the legalization of economics with the parameter of government intervention is considered.
