Criminal Liability of Terrorist Organizations in International Criminal Law and the Defense of Victims’ Rights

| In light of the increasing expansion of terrorist activities in recent years—particularly the terrorist attacks of September 11, 2001, and the terrorist movements in recent years in the Middle East, especially in Iraq and Syria—it appears necessary to further regulate this social, political, and military phenomenon and respond to it appropriately. International crimes, at different periods of time, have possessed distinct concepts and dimensions and have continuously evolved. Accordingly, it is essential for the United Nations Security Council, by drawing upon the teachings of Islamic law in addressing terrorism through criminal measures, to exercise its mandate in maintaining international peace and security by establishing ad hoc and special tribunals to adjudicate terrorist crimes. Through the development of international judicial practice in prosecuting terrorists, this approach could pave the way for a serious and continuous fight against terrorism, ultimately facilitating its incorporation into the Statute of the International Criminal Court. This article, while examining the criminal liability of terrorist organizations in international criminal law and the protection of victims’ rights, and after addressing various questions concerning the criminal punishment of international organizations, concludes that no concrete step has yet been taken to demonstrate that international terrorism is independently subject to international criminal law. Much of the discussion in this regard remains theoretical, and there is a need to establish criminal sanctions for international terrorist organizations. |
