| The arbitration agreement is one of the legal acts that has become more and more popular in the field of commercial and business activities today, so that this agreement has been recognized in many global commercial systems. In the meantime, the question of why this type of contract exists can be raised; in the sense that the reason for this contract must be clarified by relying on legal principles. The present study has sought to answer this question using a descriptive-analytical method and library tools. The findings indicate that this type of contract can be justified by legal principles such as the principle of good faith, the principle of speed, and the principle of commercial security, all of which have been accepted in the legal systems in some way. |
