Abstract: (26 Views) |
| Iraq is one of the countries that has witnessed significant development in the structure of its administrative judiciary and the organization of its jurisdiction, influenced on the one hand by comparative legal experiences and, on the other, by its internal political and constitutional circumstances. The establishment of the administrative judiciary in Iraq constituted an important step toward consolidating the principle of legality and ensuring that the administration remains subject to the law. This, in turn, created a need to develop rapid and effective mechanisms for protecting rights and freedoms, most notably urgent orders. Such orders have become one of the essential tools through which the administrative judge may intervene immediately in response to administrative actions whenever an imminent danger threatens individuals’ interests or risks depriving them of their rights if they await a final judgment on the merits of the action. |
