The Principle of Quality of Education in Iranian Law, in the Light of the Theory of Cultural Delay

Background and Aim: The right to education is one of the most fundamental human rights from second generation of human rights in the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Cultural Rights, and obliges governments to implement it. The quality of education, one of the principles of this right, is a way to achieve other principles. The theory of cultural delay indicates the mismatch between the material and spiritual aspects of culture, which leads to a decrease in the quality of education, due to the lack of goals for this right. The purpose of this study is to investigate the principle of quality of education and explain it with cultural delay theory and its application to Iranian law to determine the extent to which this theory can justify the principle of quality of education in Iran.

Materials and Methods: This research is a library and documentary, using books, articles, internal regulations, international documents and French law, in an argumentative and analytical-descriptive method and is an applied research.
Ethical Considerations: All ethical principles have been observed in the writing stages of this research.
Findings  and Conclusion: Iranian law has considered the principle of educational quality, but in some cases this principle has not been fully observed. The regulations of France are also cited as an example of comparable foreign law. The findings indicate that one of the dimensions of this theory is the principle of quality of education, but, although this principle is accepted in domestic law and international documents, this support is not comprehensive and effective, and in some cases, this principle has not been considered.
