Abstract: (9 Views) |
This research examines the regulations governing nationality in Iraq and their impact on the protection of human rights. It addresses the historical and legislative development of Iraqi nationality law, the rules governing the acquisition, loss, and restoration of nationality, and the extent to which these rules comply with the principles of equality, non-discrimination, and the right to nationality. The research also examines the legal developments that took place after 2003, particularly under the Iraqi Constitution of 2005 and the Iraqi Nationality Law No. 26 of 2006, which introduced important safeguards aimed at protecting the individual's legal status and preventing arbitrary deprivation of nationality. Furthermore, the study discusses the main Institutions and mechanisms contributing to the protection of human rights related to nationality, particularly the judiciary, the High Commission for Human Rights, parliamentary oversight, and societal oversight. The research concludes that Iraqi legislation has made significant progress in protecting the right to nationality; however, the effectiveness of these guarantees remains dependent on proper practical implementation and effective judicial and administrative oversight.
