Challenges and Solutions Facing Supervisory Bodies in Iraqi Legislation

| This study examines the challenges facing regulatory bodies under Iraqi legislation and the proposed legal and organizational solutions to address them by clarifying the nature of these bodies, the diversity of their jurisdictions, and their role in protecting public funds, promoting the principles of transparency, and combating administrative and financial corruption. The significance of the research stems from the fact that the Iraqi regulatory system is based on multiple regulatory institutions that differ in their nature and functions, including bodies with judicial and investigative characteristics, such as the Integrity Commission and the Public Prosecution, specialized technical bodies such as the Federal Board of Supreme Audit, in addition to parliamentary oversight. This situation requires an examination of the extent of coordination among these bodies and their ability to achieve regulatory integration. The research problem lies in the fact that the multiplicity of regulatory bodies may result in several practical challenges, most notably overlapping jurisdictions, duplication of procedures, and weak coordination and information exchange, which may negatively affect the effectiveness of regulatory work despite the existence of legal frameworks regulating the competencies of these bodies. The study aims to identify the main organizational and legislative challenges facing regulatory bodies in Iraq, analyze their causes, and determine appropriate solutions to enhance the efficiency of the regulatory system. The research adopts the analytical approach through examining the legal provisions regulating the work of regulatory bodies and analyzing the nature of the relationship between them and their ability to achieve regulatory objectives. The study concludes that addressing the challenges of regulatory work does not require eliminating the multiplicity of regulatory bodies; rather, it requires reorganizing the relationship between them, defining jurisdictions more clearly, and strengthening mechanisms of coordination, cooperation, and information exchange in a manner that achieves regulatory integration while preserving the independence of each body in exercising its respective jurisdiction. |
