Background and Aim:This article examines the mental element (Mens Rea) and fault in the Canadian criminal justice system, proposing reforms in this area. Materials and Methods: This is a descriptive study. Ethical Considerations:All ethical principles governing research have been observed in the presentation of this Translation. Findings & Conclusion: Emphasizing the importance of the mental element in establishing criminal responsibility, the article analyzes the conditions under which an individual can be blamed for committing a crime. It also explores possible defenses such as mistake of fact and voluntary intoxication. By reviewing judicial practices and legal theories, the article seeks to clarify the ethical and normative foundations of criminal responsibility and offers suggestions for improving Canada's legal system.
